Moved Windows On New Build - Now Selling - Issue ?

I built a new house approx 2 years ago.

During the build I changed internal walls etc which I believe isn't an issue (from a 3 bed to a 5 bed)

However I also moved one roof light from the side to the rear and added a second roof light also to the rear.

No one has noticed / cared and I've got the Completion Cert. etc

I'm now selling and wondering if I will have an issue - as they are both facing over my rear garden I'm aware I don't need planning for them but I do need Building Regs - whilst the house has been signed off for Building Regs at the time they weren't on the Planning Application so technically I didn't have the PD Rights to install them at the time.

Will anyone care ?

I very much doubt it will be a problem. If the surveyor spots it he's being extremely observant! Might lead to you needing the obligatory indemnity but it depends on the purchasers viewpoint. Is it not pd to put rooflights in once work is complete?

"any alterations to the property?" Well yes, you have permission for one thing, and have done another, so you'll need to come clean on the forms. If it doesn't freak a buyer (given the house is so new), then their sol will want either Regs or an indemnity I would think, £100 maybe? I'd be prepared to swallow that as a minimum, given the 4 year enforcement period.

He's not made any alterations to the property. They were put in during build.

Without permission, so the plans which were approved do not correspond to whats on the ground, or you could ask for permission for one thing and do something entirely different. Clearly that does not work, irrespecitve of the scale of change, its not what was approved.

if you obscure the windows with a frosted coating (temporary) will this be a loop hole

How are they going to know it wasn't done after the fact, if he has a completion certificate?

Thanks.

I can see it from both perspectives - I'll wait and see.

The main thing is that I don't want to lose a buyer later but I have had all the work inspected and whilst it didn't meet Planning Regs when built (as I changed it) - it does now it's complete (as I can do it under PD).

You dont need planning for roof lights so you'll be fine, as you could just say they were added under PD after the build was signed off.

Say nothing. If they ask tell them. If they want indemnity - pay for it, or not if they really want the house.
