...received it.

Hi,

I recently bought a car from a dealer with no logbook (not even the green slip bit).

When I went to see the car and asked about the logbook, the dealer told me they asked the DVLA for a duplicate (V62 form and they paid the £25 fee) so the new buyer wouldn't have to do the procedure.
They told me they would send it to me as soon as they receive the new logbook, so we can transfer the name of the keeper with the DVLA.

I knew this was a bit risky, but after doing an HPI check and after checking if all the paperwork was there (MOT certificate, service history, bills), I decided to pay for the car. I signed the contract with the dealer and made sure I got a receipt.

Now my situation is, I'm the owner of the car, but I'm still not registered with the DVLA (not the keeper yet).
I'm not in the case where Im waiting for the DVLA to send the logbook with my name on it, because the garage asked for the car's logbook before I even bought it.
So basically the DVLA doesnt know I own the car, and its probably still registered under the previous owner.

Rang the dealer to talk about the tax, he told me I could still use the previous owner's tax (still valid) because the car is still registered under his name.

Now I'm just wondering

- Am I allowed to drive with no logbook (im insured,etc...) and not even the green slip? (so basically without being registered)
- Is there any chance the previous owner kept the original logbook and didnt tell the DVLA he sold his car? If he's got the logbook, a spare key and knows my address, he could be able to steal the car as well

I know it was a mistake to buy before having the logbook, I thought it would be easy to just get a new one since we can ask for one on the DVLA site in case it's missing

You will be fine to drive the car.

As soon as the new logbook arrives just tax it yourself using the green slip.

All will be fine.

What if I get arrested by the police, do they usually ask for the log book?
I rang the DVLA and they told me to keep the car off the road as long as Im not registered.

I'm just worried the previous owner kept the original log book; seen as the car is still registered under his name, he can still pretends he owns the car?

Why would he want to pretend he still owns the car?

Last time I insured a car, I'm sure the broker asked me to confirm I was the RK as well as the owner. Probably worth checking this.

I mean if the previous owner has a spare key, knows my address and where the car is and is still the reg keeper, he could be able to steal the car and if he got arrested, he might be not the owner but he can still prove he's th keeper?

Stop flapping about nothing. Drive the car. If the V5 doesn't turn up after a while, apply for another one.

Registered keeper and owner are two separate things, the v5 does not confirm ownership of the car.

Ignore this nonsense. If the car is taxed, has an MoT certificate (if needed) and you are insured to drive it, then it matters not that you are not the registered keeper.

It's only going to be a problem if it isn't taxed.

If you go to the direct gov website where you can check f it's taxed check the tax status of the car there,

The tax could transfer with the car if it was sold before 1 October 2014.

I thought that it could also transfer with the car if the dealer bought the car before that date.

Any sale completed before 1 October could include the tax if the parties agreed so.

I think you'd better sleep in the car until the logbook comes through just in case they come for the car.

3 words: log book loans

https://www.moneyadviceservice.org.uk/en/articles/...

They don't show up on HPI checks and you can loose the car if the previous owner is In arrears on the loan, I think.

Sleep well OP.

Just apply direct for a new log directly yourself.

The car was sold to me after the 1st of October and the tax from the previous owner runs until beginning of March

In the process of receiving a new Logbook so I can register the car under my name, but in the meantime the DVLA isnt aware I bought the car? Rang them today and they didn't receive anything yet

The dvla are not usually that helpful with v5 log book stuff.
Usually takes a while as they are processing all the new ones from septembers new registrations.
