I thought they could at least tell me if the previous owner contacted them to ''unregister'' the car,
or I thought they could confirm they received (or not) the V62 form from the garage

As you bought the car after 1st October, tax won't have transferred on the sale. Send off for the V5 now and, if the cost bothers you, seek a refund of the cost of as a goodwill gesture from the dealer.

If it turns out that the car was subject to a loan and you therefore do not have good title to it, you will have a slam dunker claim against the dealer, whether or not the dealer knew of the loan.

I do not think you will have the protection that the HPI check provides because one of their checks is the issue number and date on the V5. You would have seen on their T&C's that you should not go ahead with the purchase without it.
Tax is NOT transferable after 30/09/14. So car will not be taxed either if bought after that date.
No point in doing an HPI check if you do not follow the rules or advice.

No it doesn't. Under the new rules from 1st Oct, there is no continuity of tax - the previous owner's tax is irrelevant to you. He will be receiving a refund for any whole months remaining, and it's your responsibility to tax the car afresh as soon as you buy it. I believe you can do this online, and by definition it must be possible to do this without the V5, although I can't confirm this through personal experience as I haven't bought a car this month - BV, though, has probably bought at least 10 rusty old heaps in the last couple of weeks so he'd know.

What, only ten? I must be slipping. You need the V5* or the tax reminder to tax a heap online.

DVLA turnaround time for V5 on change of keeper seems to be about 2-3 weeks at present.




*To be exact, you need the reference number that appears on the front of the V5.

Not insured correctly if you have stated you are the RK

Looks like you've bought a pretty driveway ornament until the v5 is sorted, all sounds a bit suspicious though to be honest. Dealer not having the V5 would have me walking away to be honest, plenty more cars out there!

I meant the tax from the previous owner ''was supposed to'' run until end of March. I know rules have changed and the tax is not transferable but the dealer told me I could still use it until the RK name is updated.

I'm going to leave the car off the road in a safe place until I get the V5 from the garage (They asked for one filling out the V62 form when they received the car and realised there was no log book).

I thought the HPI check covered logbook loans as well :s

It's your responsibilty not the dealer and ultimately you who can be penalised. Ignorance is no defence.

It is the OP's responsibility to tax the car, but it is not his responsibility if the car turns out to be subject to a loan and the purchase is ineffective. In that event the dealer will be liable to the OP, as every sale impliedly warrants title to sell.

I just got a call from the garage this morning and they received the logbook!!

I asked if it was the duplicate (they sent a V62 form just in case the original didnt turn up) and the dealer said it was the original one - which is probably the case as the V62 form was sent only a week ago, so they wouldn't have received a new logbook by now (takes at least 4 weeks).

This is good news (turned up quite quick at the end) but I still find it very weird the car wasn't sold with a V5 in the first place. I asked the dealer where it was, and he said he didn't know.

Now the garage can either send the V5 to me, or I could come and pick it up. I said I would go, don't I need them to sign it etc?

What else should I ask/check with them before I leave with the V5?

Insurance hasn't been checked when retaxing a car (by whatever means), as of 16 December last year smile .

PS Does the dealer have the "new keeper supplement" for the new keeper?? wink

I'm not sure if it's just the new keeper supplement or the actual V5C. I'd rather go and sort out the paperwork with the dealer at the garage. Plus, from what I've read, the trader is in charge of sending the V5 to the DVLA, and not me?

I will check if the V5 is the original one like he said, how can I tell if it's a duplicate?

I will carry out a full HPI check just in case. The trader did one (using Autocheck) but apparently logbook loans don't show on a basic HPI check..?

Ok, I picked the V5 at the garage yesterday.

It was the original one with the name and signature of the keeper, so the garage didnt fill out anything. I kept the green slip and went to the post office to tax and send the V5 to DVLA.

I checked the V5, everything matched with the car (VIN, registration etc..), but the engine number was different from the one I had on the receipt... ??

I double checked the car's paperwork again and nothing mentions an engine replacement :s
