Another parking question

In this picture, the carriageway is the tarmac between the two sets of double yellows. The area to the right has always historically been used for parking, but the yellows have been added recently. So, are the Landie and the Vauxhall(?) parked legally or illegally?

Interesting.

Parking restrictions include the pavement for obvious reasons, but there is no pavement here.

I would say the council would struggle to prosecute for a contravention.

Parked illegally on carriageway, which extends from boundary edge to boundary edge of the road (carriageway) I may have the wrong words but they ARE bang to rights

eg Hedge, Wall, cliff edge etc

However the Local Authority can't just rock up one day with a pot of paint.
There has to be a correctly specified and implemented TRO to make them enforceable.

Though I have to say that the way it has been done makes no sense.
If they don't want people parking there why don't the yellows run along the verge on both sides?

I'm wondering whether it has been done that way to entrap uninformed people.
Or maybe there were vehicles parked there when the painting gang turned up.
They shrugged their shoulders, threw away the template, and just worked round them.

Very badly painted lines. I wonder if they were actually done by the local authority?

I'd be inclined to write to the LA asking for clarification complete with
a copy of the TRO used to support the lines. Looks like a typical display of halfwitted council incompetence and waste to me as a layman but without getting the TRO one doesn't know

I had already seen the lines a few days before I took that photo, so no, that wasn't the case (although I have also heard of that sort of thing happening).

Exactly, my bold. The TRO will have been correctly made. Have you got any experience of the TRO process? The internal kicking the TRO officer would get from the elected types, if he got it wrong, would be massive and would open doors to lots of claims. TRO's are (certainly in my area) 100% watertight and triple checked. I know. I've spent a lot of time doing them.

Regarding why the lines are where they are, probably because it's the extents of the road. You don't have DYLs at the back of the footway, do you?

OP where is the lane? Can we have a google maps link, and which authority is it? I might be able to get the legal wording.

I have first hand of Norfolk LA and a TRO that was completely ignored and non compliant signs made, installed and fined against. They faught my ticket at every stage even though it was clear they were totally wrong and wasted money right to the adjudicator who dismissed it at a stroke.

These folks have plenty of form hence I advise getting the TRO to validate it.

As for LA, I'm not 100% certain but probably Tonbridge & Malling (if it's not county council - Kent).

Thanks. It would be Kent CC (as the highway authority) rather than Tonbridge that deal with parking tickets and enforcement. Unfortunately, I can't get access to their mapping system. Essex has an open one that pretty much anyone can see, but apparantly not Kent. Sorry.

No prob, thanks for trying.

I've actually just been back down there to walk the dog and just about every space in that lane has a car in it - half term, and the local area with the lakes is popular round here. I didn't hang around long enough to see whether the wardens turned up or not.
