A tragic case for all concerned.

It's shocking that a child was shot dead for waving a toy gun around in a state where it is legal to wave real guns around.

A 12-year-old boy has been shot dead by police in the US as he played with a fake gun in a park.

Tamir Rice, who was black, died of his wounds yesterday in hospital after being shot twice in Cleveland, Ohio, on Saturday.

A member of the public had phoned police saying people in the playground were scared by someone brandishing what looked like a gun.

In a recording released by officials, the caller can be heard saying: “There’s a guy with a pistol…you know, it’s probably fake but he’s pointing it at everybody.

“I don't know if it's real or not."

The 911 responder twice asked whether the boy was black or white before dispatching officers.

When police arrived at the Cudell Recreation Center park, they told Tamir to raise his hands, deputy police chief Ed Tomba said.

When he allegedly took the replica gun from his waistband, an officer fired twice despite the fact the suspected weapon was not pointed at them and no threats were made.

The gun was an "airsoft" type replica that resembled a semi-automatic handgun. Fake weapons normally have an orange safety indicator on the muzzle but it had been removed, police said.

Cleveland police are investigating the shooting and the two officers involved have been placed on administrative leave in accordance with procedure.

Tamir’s father, Gregory Henderson, told local newspaper the Cleveland Plain Dealer that his son was a “respectful” young man and said the police should have tasered him instead of using live ammunition if they felt threatened.

Referring to police, he added: “You shot him twice, not once, and at the end of the day you all don't shoot for the legs, you shoot for the upper body.”

After reviewing the evidence, prosecutors will present the case to a grand jury, which will decide whether the officer was justified in using deadly force against the boy.

A lawyer for Tamir’s family, Timothy Kucharski, said he had gone to the park with friends as normal on Saturday afternoon but did not know the details of what led to the shooting.

“We're ultimately going to find out what happened,” he added.

Jeff Follmer, president of the Cleveland Police Patrolmen's Association, said the officers involved were not told the caller thought the gun might be fake.

Tamir’s death has sparked calls for new laws in Ohio to require all BB guns, air rifles and airsoft guns sold in the state to be brightly marked to show they are fake. A similar bill is being implemented in California.

It comes after another black man with an air rifle was shot dead in Ohio in August.

John Crawford III, 22, was killed after a man called 911 to report he was carrying a gun in a Wal-Mart supermarket.

A bad situation all round. The parents fault for buying their kid a pellet gun, and a police officer for overreacting (only one of the three actually felt it necessary to shoot).

Unfortunately the parents will face no blame for their part and unlikely the police officer will get more than a slap on the knuckles.

Quite sad how the news sites are already trying to imply that race was a motive for the shooting.

Crazy. Do they not have tasers or rubber bullets for such events? I'm so glad I live in this country and know my son isn't going to be shot for playing with a toy gun.

The kid didn't look 12 - could have passed for 16 or 18, the gun looked real. He failed to comply and went for the gun.
That's why toy guns have to/should be made to look like toys.

Not sure if you live in the UK or not. If you do though, how about a chair leg instead of a toy gun?

It doesn't matter what the caller says, the police have to act with what they see before them.

The BB gun had the orange tip removed and orange paint scraped off.

I think I read that the orange safety indicator bit that marked it out as a toy had also been removed.

It's shocking that some poor copper had to respond to some scumbag waving a gun around that someone had intentionally modified to remove all obvious signs that it's a fake.

The sooner the world stops looking to excuse stupid behaviour, the better. The most offensive weapon I wandered around with in my youth was a Super Soaker. As a result, nobody shot me.

Entirely deserved by the scrote, and entirely expected of the chip-on-the-shoulder population over there that it was a 'poor, innocent kid who would sit all day eating ice cream and helping old ladies across the road' who was 'brutally murdered by a power-hungry racist cop'.

No, the lives of scumbags running around thieving and waving guns around is a cheap commodity. To make this about race is utterly puerile, and pointless. In both cases recently, the 'victim' was doing things that made themselves likely to be on the receiving end of the long arm of the law.

fking mental that people seek to excuse the behaviour of the first, and the carrying of an imitation firearm modified to look real of the second.

I don't know if a 12 year old is old enough to make sensible decisions and fully consider repercussions.

Police Officers have to deal with stupid every day, all over the world. It's strange that an unreasonable amount of young blacks get shot first.

Children, like dogs, like all creatures, are the product of their guardians and custodians. Bring them up to behave that way, and they will behave that way.

I knew from age 5 that guns were bad, and from age of about 8 that running around with one was only going to end badly. I wasn't allowed my spud gun out of the garden, and I'd never have dreamt of pointing it at people. Ever.
