Looking for an honest opinion what chances I have to win my claim against my local bus company.

I was driving on a road in town that run between two golf courses so narrows down in places but is just wide enough. Was on my lane, as much as I could be to the left without mounting pavement and bus going opposite direction has clipped my drivers side wing mirror. I am absolutely positive that I was as much to the left as possible and at the time bus driver didnt say much. We filled in the form and went separate ways as I had wee one in the car and was on the way to the nursery. 30 min later I phoned the number on the form and was advised they will review cctv and get drivers report before accepting responsibility for an incident. Week later they come back to me and say that I AM RESPONSIBLE. Ffs. Driver claims he was as much to the left as he could and I was driving too fast (I wasn't).

So its basically his word against mine but also they say footage is dark (it was 7.30am) and they are not willing to show this to me due to data protection act.

What options I have and what chances of them accepting responsibility without my witnesses. Are they allowed to deny me watching the footage if they use it to determine that its not their responsibility?

Your options are the same as if there was no video. If you think your case will stand up in court, get the damage repaired then take the company to the small claims court for the repair costs. Inform the company first of your intentions.

Are we just talking mirror damage? Unless it's going to be a silly-price mirror, swallow it. If you go through insurance, it'll go 50/50 at best - and that WILL end up costing you more.

Its Audi S4 - Audi parts and labour to fit came to £780... I can buy second hand and fit myself but that still will be £200-300 as aluminum caps and antidazzle glass aint that common and cheap.... Besides its their fault so I find it really hard to just accept defeat

This. From personal experience, though not related to motoring, bus companies will do anything to avoid responsibility, including losing CCTV footage, drivers 'disappearing' or having memory loss.

Speed does not change the width of your car.

Then again if you had stopped it would be his fault as he would have to run into you.

What data are they protecting on the cctv? Your numberplate?

OOOOps sorry didn't realise it was 5 or 6 times more expensive for an O/S mirror

I could be wrong, but you might be able to insist on the footage - something to do with regulations governing CCTV in public? Maybe contact https://ico.org.uk/

Can you not do a freedom of information request for the cctv?

Might cost you a few pounds but if I recall correctly there are only a few specific reasons why they might refuse. Can always threaten them with the information commissioner if they get obstructive..

CCTV wont prove anything, just which direction the vehicles were travelling. If you were stationary then it would be the bus hitting a stationary vehicle, if you were moving even at a low speed than it would be 50/50 as technically you hit the bus with your mirror the same way the bus hit your mirror, it can go on and on

From bitter experience, I can agree with this. The standards of bus driving around here and the attitude of the bus company compete to be the worst.

What, if any, road markings were there?

No road markings means 50/50 unless you were stopped
