Is this fraud?

On my "Ringing Kits" thread...

...there have been a few examples of kit cars using classic or other kit car identities. The Locust with the chassis plates and log book from an old Dutton or Westfield for example regularly crop up.

...Locust is registered as a 1968 Elan, insured as a Lotus Super 7 (that wasn't introduced until 1970) and for sale at over double the price of a genuine properly registered Locust...

It obviously is not a 1968 Lotus Elan, nor is it one of the 160 genuine Super 7's.
If the Elan identity has been used to avoid an IVA/SVA, to age the vehicle (Tax evasion) or elevate the agreed insurance value or sale price is it fraudulent?

If the seller was pretending it WAS a genuine Elan, in order to try to sell for Elan values, or if the owner claimed it was a genuine Elan, to try to get a payout for Elan value on an insurance claim, that would be fraud. Is it all sorts of various offences, probably under construction & use? Yes, quite likely, it is.
But is it fraud? No. The seller of the red one might be an idiot, and might be spouting all sorts of rubbish, but he's quite open about it being a seven-alike kit.
Looked at the first one, 2 litre crossflow? Not a chance! I did have an 1840 one, but that was done by offset boring and the one pictured is still on a single carb. So I'd even doubt it's the reasonably common 1700 one. Standard capacity of that engine is 1600, and on the last standard re-bore, 1660.

I made a similar observation on the thread - which was followed by some informed dabate...V8forweekends said:

So it's just a ringer using the identity of an Elan.
I guess the £13,000 asking price could be the £5,000 value of a legitimate Locust with the price of the "NVV 7" number plate.
Except he says the plate's not included.I guess the £13,000 asking price could be the £5,000 value of a legitimate Locust with the price of the "NVV 7" number plate.
The number plate or the chassis plate?
