I would really appreciate some advice with regards to the following situation I am currently in.

In Nov 2013 I arranged a business lease on a BMW 520d via BMW Bradford. The car is on a 2 year Alphabet lease with a total of 16,000 miles. I have bought it primarily to drive in the city.

Upon reaching 8,500 miles I got an indication that the service was due in 500 miles, which I thought was quite odd but called the contact I dealt with in Bradford who told me that whatever would be needed to be done would be covered. Closer to the time then I then called the service department who said I could take it to any BMW dealership nationwide and they would be able to check that it was an Alphabet car and would not charge me.

I subsequently booked the car with Berry Chiswick and at the time of handing keys I also told them that I was getting a Brake disc warning light. They told that I wasn't too worry about anything and that everything would be covered.

I waited for the service, was told that the sensor on the brake was faulty and after several hours after having come back home I got a call from Berry Chiswick to tell me that my lease didn't have maintenance included in the lease and they have an invoice that needed to be paid.

I then called my contact in Bradford who couldn't recall my conversation and denied ever telling me that everything would be covered. He then went on to say that if my lease is for 16,000 miles then I wouldn't have been offered a maintenance contract as there wouldn't normally be a serviced required and for the car to require a service at 9,000 miles was particularly odd. I then told him that after conducting the service the OBC was now indicating that the next service was due at 6,000 miles. He has asked me to bring the car in next week for an inspection as he suspects that there is a problem with the OBD or some sensor.

In the meantime, the service manager at Chiswick called me to also offer to take a look at the car which I did today and they said that Bradford had made a mistake of giving me a lease without maintenance as these cars can sometimes require a service before 10,000 miles, that the next service which is due in 6,000 miles is for front brake pads but this may be due to the brake pad sensor, which was supposed to be fixed last time (and was told I could bring in it again for this to be checked some other time). I was also handed the £400 invoice but they appreciated that I would not be paying this right now, till I showed the car to Bradford.

I can see that Bradford will say that since no maintenance was part of the contract I am liable for the charges that I need to pay Berry.

I feel that at the end of this all I will be forced to pay when I have tried to ensure I did everything correctly.

This seems to be a common issue with cars with variable servicing intervals. I've got a Golf R on order and have been asking myself the same question. I think the leasing companies have been ignoring the issue to ensure they get a quick sale. I hope you get a quick resolution

What does the contract hire document you signed say you have? Is it non maintenance or with maintenance?

As above your contract will be maintenance or non maintenance but even then £400 is taking the mick as all that would be due would be oil change and oil filter I assume. All faults should be rectified under warranty. Even with a 2 year lease you are likely to have to pay for one service if it is non maintenance because the maximum interval under CBS will be 2 years and I was told with my 640d that if a service was due within x of handing the car back then I would have to get it done. Also the cars reg date from which the CBS works will be an earlier date than when you received it.

Funny ...I live in chiswick and there is something about that place ...the people the attitude....ive never followed through with any sales or services there .....preferred to drive miles rather than deal with them or give them my money...hope you get this sorted must be frustrating and a wind up.

That makes a lot of sense Doc241. Thanks for all of your responses.

No, contract does not have maintenance included but I was led to believe that my monthly payments would be all that would be required given that it was a 2 year lease with mileage limited to 16,000 miles.

Bradford are saying that there could be something up with the car whereas Chiswick want to be paid £400 for an oil service and fixing a faulty brake sensor which still isn't fixed.

I am travelling up north next week and shall report once I have seen Bradford.

My 911 is right now proving to be a cheaper car to run than a diesel 5 series.

It seems very unusual that the car would require a service after just 9000 miles. The fact the dealer now says it isnt due for another 6k seems right as about 15k is the interval I'd expect.

What exactly have they said the car requires? New brakes?

Yes they said by inserting my key in this thing that the front brake pads are what their system is saying would be due in 6000 miles, but even that is in doubt as Chiswick then said that the front pad sensor is faulty. This was replaced but Chsiwick said it was still indicating an error and I would need to bring it back in.

Just to update you all I managed to get a satisfactory outcome in the end. After meeting the Service Manager in Bradford he contacted Chiswick and said that since they were the ones that had ultimately done the work they shouldn't have told me that everything was covered unless they had done their own checks. Therefore Chiswick ending up paying and Bradord have said that they want to look into brake sensor themselves when I'm next there.
