Not me driving obviously, circumstances are a family member was at a friends house party and long story short his hire car car keys were taken by one of the friends friend without permission but my cousin is now being summoned to court for speeding even though he had filled in the form that the police force had sent for the drivers information. Is he expected to prove he had returned the said form or is it as simple as providing a statement of truth by post to the court or is it best he attend in person (he is away from UK on holiday)

To be clear - has he been summoned for excess speed, or failing to furnish ?

Neither it's a virtually dormant account that the OP is posting from. Easyer holidays end soon, so it's a farewell gift from the school kid

There's a trend of whacky scenarios whenever the kids are on holiday. The OP can't even get his story straight about why his cousin is going to court.

Here's a test for the Op to see if he is real and a Claims Manager as per his profile. What impact did the Consumer Insuramce act have on Utmost Good Faith? Simple if he does the job he claims, less so if he doesn't.

Read my post again, like I said he is being summoned to court for speeding, I presume he is being summoned because the police force did not get the post which he had returned and how does me answering your question prove if I am a claims manager or not.

If your not going to help in answering the question then there is no reason to add other comments!

That's two different reasons why he might have been summoned. You still haven't answered the question properly.

Summoned for excess speeding, he said he called the police and they said to discuss with the court now that he's been summoned.

Just out of curiosity what happened to the car?

Did the mysterious guest just take it for a hoon (most hire cars are st) and brought it pack to the party without your "cousin" knowing anything about it?

How did he manage to lose the keys?

How did he get them back? Actually it's more likely to be an "it" than a "them".

Or did the culprit take the car home? Then what happened to the keys?

Either way it's been TWOC'd so why is your cousin not doing anything about that?

What are the hire company saying, as they will have received the S172?

I'm with Loon, this one smells fishier than a very fishy thing.

Does he know the name of the friend's friend that stole the car and took for a joy ride?

Will this friend or any other of the friend's friends stand up in court and point the finger at the friend's friend that took the car?

Loon, wouldn't he get a s172 thingy, summons first rather than speeding?

ETA - neonblau, good point the hire company would get the s172.

The hire company named him. With speeding you're guilty unless you can prove you are innocent.

Not sure what the big deal is here? The OP suggested his family member has named the friend's friend, it's just that the letter didn't get there.

All he'll have to do is get the process restarted. Maybe the Court 'system' can intervene and get it restarted or perhaps, as it sounds like a load of baloney even if it's completely true, he'll have to appear in court and plead not guilty. Who knows, maybe he'll even get off?
