I now have two abandoned vehicle on my car park of nine spaces.

One has been there for four weeks and is locked.

One has been there for a week and has been crashed and is unlocked.

I have called the police and they are not reported stolen so they don't care.

I have called the Council and as it's private land they don't care (I get fk all for my £12,000 pa business rates).

So, I need to ascertain the legal process to have them removed privately.

Anyone know please?

Drag them out onto the street and leave them on a double yellow.

They'll soon get removed.

I think the Council might be shirking their responsibility.

Google shows lots of links to council websites on dealing with an abandoned car on private property.

The answer below was posted on this thread back in 2010. Not sure if the law would have changed since then.

Council want reminding of their powers under Section 3 Refuse Disposal (Amenities) Act 1978:

Where it appears to a local authority that a motor vehicle in their area is abandoned without lawful authority on ANY land in the OPEN AIR or on any other land forming part of a [F1 highway] [ F1 road], it shall be the duty of the authority, subject to the following provisions of this section, to remove the vehicle.
(2) Where it appears to a local authority that the land on which a motor vehicle is abandoned as aforesaid is occupied by any person, the authority shall give him notice . . . F2 that they propose to remove the vehicle in pursuance of subsection (1) above but shall not be entitled to remove it if he objects to the proposal . . . F2 within the prescribed period.

So you have made enquiries of your neighbours to no avail and no body has been to it then it has been abandonded? They serve notice of land owner and if owner not forthcoming they ghave power to remove and deal with.

OR

£2.50 to DVLA with Reg No. Point out problem and ask for last Reg keeper. Put Missd Marples hat on and try and trace current owner.

DVLA will not give you the owners details. No matter what link anyone posts on here, they will not disclose it to anyone other than a large organisations that can demonstrate exactly why they need the info. That's limited to plod, insurers, councils and solicitors in my experience.

Get some mates, a 4 x 4 and drag the *ucking things on to the street at the weekend,

Question, can you lock your car park ? if so perhaps that's the way forward?

No the car park cannot be locked, it's an office park with 100 odd parking spaces. I have just been unlucky in that both cars have been abandoned on mine.

Don't bother trying to move the car. Phone up the council in the morning and tell them you spotted a group of youths around the car the previous night and you had ask them to move on. Say you are worried about vandalism or arson, they'll soon move the cars.

Yep. Hook up a full size Landcruiser or similar with a very short (and strong) strap/chain and it'll drag them out just fine even if all four wheels are locked.

Do you own the offices or do you rent them?

This would be, and has been the way I'd do it. Have to move them from my driveway occasionally

What does you lease say, are the spaces demised in your lease or just allocated? If allocated then maybe its the landlords problem as his failure to manage the car park means that you are suffering a loss?

Is your lease a TIR or FRI (Tenants Internal Repairing or Full Repairing and Insuring?)

If the landlord won't get them moved just park in someone else's space.

Is the answer then to simply throw this back to the landlord? Someone is denying you access to a facility that you are paying for.

It's a full repairing and insuring lease with the spaces identified in the lease so not the landlords responsibility.

I have no right to park in someone else's spaces and it would be unfair of me to do so.
