As the people caught taking photo's are being prosecuted does this mean you cannot take photo's of a crash scene and under what law would they be charged?

I would suggest that it is likely that the people they are looking to prosecute were driving at the time of taking photos/video.

It actually says in the article that the drivers being prosecuted were caught using their mobile phones whilst driving.

So presumably, if a proper camera was used then they couldn't be charged with mobile phone use?

In that case, I suspect that a charge of not being in proper control, might be issued instead.

There were a few minor injuries, and a few in shock, but they had to grin and bear it due to all hospital beds being full of dozy HGV drivers.
Police were asking drivers not to go down to the woods today while on the 20 mile diversion.
