just used my mothers car and someone has just smashed into the back of me ( i was stationery waiting for someone to turn) just got home and checked my moms m=policy and she hasnt put me on as a named driver.

Have you got your own car/insurance that lets you drive other vehicles on a 3rd party basis?

If the police get involved, expect 6 points and a fine.

If they do or don't get involved you can still claim off the other driver's policy regardless as long as liability isn't disputed.

i have fully comp on my own car -and can drive other vehicles it says.

The old lady smashed straight into me and then pushed my car forward into her son's bmw who she was following. His car already had a massive bash on the back and there wasnt any damage he said he could see to his car.

i put my phone on video and video'd her saying she thought she would stop in time.

Claim direct from her insurance. In the circumstances, it would be very hard for her to deny liability.

What cover does your policy provide? I assume it's third party for DOC.

That means that other cars (the one in front and the one behind) can try to claim from your policy for damage to their cars. Sounds unlikely, but if they do there's no excess of yours involved.

That also means that your ins co won't be fixing your (Mum's) car so you will need to contact the insurance company of the biddy behind to get that fixed.

Wrong on 2 counts. If son claims against OP, OP should deny liability as he wasn't negligent and direct son's claim to son's mother who cause that accident. Even if the OP had run into rear of car in front, there would be no excess payable. Excess only applies to your own damage, not damage you do to someone else.

Not your fault someone drove into you, sorry for that, but you ought to be more careful about making sure you're insured. I think these doc bits sometimes have clauses to prevent you regularly driving other cars, hopefully you're covered.
Even though in this case it shouldn't concern your insurer at all.

a lot of family members involved, all sounds very council, it is going to go very wrong, and require a dna test or lie detector to sort out

i dont think it was a cash for crash thing - they where just turning into a pub car park to meet family and she was following him.
He is a company director. If that makes it any better!

This is the second crash that the car has had now and it's not even a year old! Started to think it's jinxed.

I've had jinxed cars.

I was rear ended on the motorway that pushed me into the car in front. I was told technically the car I hit claim from me, I claim from the car that hit me including passing on the claim of the car I hit. It panned out that the other two cars were with the same company, the guy that hit me coughed straight away (difficult to do otherwise) and the insurance company sorted everything to save me the hassle.

I was impressed that if an insurance company knows they're paying they can be very helpful and quick, gave me a decent car while mine was away etc. You do need to notify all the insurance companies though, I suspect both yours and your mothers.

Most DOCs will not allow you to drive a car belonging to another family member. Just checked 4 policies with different companies (I keep scanned copies of all the family insurances) and all 4 prohibit DOC with immediate relatives cars.

ones I have seen limit driving any car based at the same property - so I could drive my parents' car as they live elsewhere, but if I had a lodger, couldn't drive their car as it would be at my property...

OP def. worth checking whether you were actually insured...
