Hi all.

If someone who works at two different rates of pay leaves their job, and is entitled to some payment for outstanding holiday when they leave, how would the payment be calculated?

I'm asking on behalf of my brother who works at a golf club, earning more when he's acting as chef than when working behind the bar. My guess is that he should be paid at his average hourly pay over the previous 12 weeks.

The government website does refer to averaging things over 12 weeks to calculate the holiday due for people who do irregular hours, but I can't find anything about vary hours AND varying rates of pay.

What happens when he takes leave normally? What rate is paid? I would think this is your answer.

I'm not sure but I've put him on to ACAS now as it seems the answer isn't a simple one.
