Can someone clear up a few things for me please?

Firstly we need to rebuild our garage as it's falling down. It's built against, but not part of, the party wall between us & the neighbours.From my reading of the party wall act we'd only need to notify our neighbour in writing if we dig new foundations, is that correct?

Secondly, when I've checked planning law it says garages etc can only be 2.4 (or 2.5M I forget exactly) high & single storey. Our neighbour thinks she can build two stories without planning permission. Who's right?

With the first part that's right, as long as you don't interfere with the party wall either.

The second part, i'm not sure of.

You can build 2 storey but not on the boundary under Permitted Development.

For an outbuilding (garage) you can be 4m high at the peak of the roof, but the eaves must be max 2.5m high. For no planning, it would need to be at least 1m from a boundary.

You can only build a 2 storey extension to the rear under PD , not the side, even then it needs to be 2m from the side boundary and at least 7m from the rear boundary.

Garages within 2m of the boundary are restricted to a max height of 2.5, if you want 4m it needs to be at least 2m from the boundary and have a pitched roof .

But there are lots of other restrictions that may apply as well.

Her outbuilding she wants to extend upwards is connected to the boundary wall, so will need planning from what your saying.
