Question aimed at Law type people really

I run a small water treatment company, we have sold 2 items the past couple of weeks via a phone call, payment vie C/card (paypal) items then sent.

It has since transpired that the C/cards are not what they seem, and paypal have opened a charge back.

Now, we are not the only company to fall fowl to this! there are others, selling the same products.

The items purchased are now on ebay, via 2 ebay accounts, some have been sold, some are still there, there are also other items that are for sale too, i guess via the same means.

Now heres the hard part, the police don't seem to care! we have to speak to Action Fraud, and they seen to want to take 28 days to look at the case!

We have names and some address's of the people involved but seen not to be able to get any where.

Any pointers on what to do.

To me it looks like a well run outfit.

The addresses you sent the items to are likely to be duds or the deliveries will have been intercepted/redirected before getting to those addresses. Its likely the buyers will have hijacked the paypal account used to pay for the items - hence the charge back so its unlikely the Police will be able to do much in any case.
Complete the online action fraud referral pronto and theyll look into any links with your and similar frauds.
Can you 100% confirm the items for sale on ebay are yours.

Had a similar thing happen to me a few years ago with some capital equipment. Even though we knew where it was the police weren't interested. Gave up with them in the end and claimed off our insurer.

Wouldn't use PayPal if they paid me.

Items mede it to address sent we have all the scans of signatures, and names.
They have used credit cards to pay, we use the Paypal system.
Yes we will fill out the online form.

If sent by courier - check with the company that they werent diverted.

Paypal seems, to be like that.

Those that did not use paypal, also stand not to keep there money either.

Seems that the long number, Exp date, last three on the back and registered post code is not assurance that all is well.

No they were not, items made it to address sent i have the scans.

Weren't you covered by PayPal seller protection on these? If you have signed for delivery you should be OK.

We have submitted all our documents to Paypal, they say they put the case the the card issuer and its there disision if they will honour the payments.

PayPal seller protection covers your loss unless you failed to meet the criteria. Let the real credit card provider deal with the theft/deception & get on with your life it's really not worth the effort

Easy to say, but we will be £2500 out of pocket.

Why? Are you saying you didn't meet the criteria for seller protection? It's quite clear if you did or not if you look at the PayPal transaction. All I needed to do was prove I had sent it to the address registered to the verified by PayPal account used to make the payment & used a courier service that provided a signature on receipt.

The lack of inertia by the police tells you all you need to know about how high they have prioritised your concern.

I had a claim last year albeit for a lower amount £500. Buyer claimed fraudulent use of credit card, took about 10 days to get the funds released, never heard anything more about it.

Hope you get your money back

It seems that we have not met the criteria! we don't have a postal address that was registered with Paypal

So looks like we stand to loose out.

Yes, I think you will be up st creak then. No harm in keeping going with it until PAYPAL say 'no' though

Looking through all our recent payments, there is only a couple that have confirmed address's, its not something we had not taken into account.

Will look into other card payment methods i think.

LoL, that has been discussed, and as for the ones that were on eBay they kept being won by newly registered users smile (not me)

They on gumtree at the moment, and they have other items on eBay, I feel sorry for everybody as i can see whats going on, be great if the boys in blue would just go round there and sort them out!
