I just asked the question pal, it may have a made a difference as to weather or not the sale went thru.

Agree, if the buyer asked it might be relevant, depending on the OP's answer.

They do. Someone recently even cut and pasted a helful note, regardless of the incorrect date in it...

The point i am trying to make is why the buyer is stating 'fraudulent misrepresentation.', and what angle the buyer is working from. I wasn't thinking of a trader but i think the op bought the car did a trip and some tracks and sold it on.

I think the buyer asked, has it been tracked, and the seller said no. The engine has gone kaput (or might be alright), but i am just trying to understand why the buyer would use such a strong term in the letter.

How can you possibly extrapolate into that theory from what is posted on this thread unless you know the angle of the buyer? Is this particularly helpful to the OP - is this letter specifically listing this as a point or is it just a generic outpouring of terms in an attempt to gain some credence?

Not sure what you mean but the email received by the op says, 'Fraudulent misrepresentation'.

This being PH I would surmised an argument from no information other than my vivid imagination, but it keeps the thread going.

I'd sooner the thread died down to be honest. I'll respond if I hear back, if not in a week.

With regard to "did some tracks", I stopped off at the 'ring on my way down sure, but the car was not hard pushed. It was raining. It's a public road anyway smile

Oh, and to put this to bed, yes the buyer is aware of it. I even showed him the picture and joked he could put a silly sticker on it.

ETA: I've changed my username if anyone is wondering who the hell I am! nuts

Nope, must be someone else.

Had a text this morning off the buyer stating the cars off to a garage on Tuesday and he'll update me what the outcome is. Haven't responded yet. Don't understand how someone can send that legal bks through email then send a polite text a few days after.

I'm not sure about the tone, but if I thought I had been deceived by a private seller who had misrepresented the car, I'd probably send a very specific "this is what I assert you have done, what you need to do and this is what I will do if you don't". Polite but direct. Which in fact I have done in the past.
