Hi All,

Feeling really uncertain so hoping you can help.

I was caught doing 43 in a 30 and just received the notice of intended prosecution.

How likely is it that the case will be taken to court?

Also i have been driving for under 2 years so if i get 6 points i will lose my licence. is this likely?

I did see that but obviously says 4-6 points so wasn't sure if someone had had a similar situation. Also, all over the internet it says that if you don't get a fixed penalty notice with the NIP then you will likely be taken to court.

I got done for 44 in a 30 and it was 3 points and a fine.

Thank you! When was this? and did you get offered the 3 points and a fine straight away or did you send off your details first after getting the NIP?

Not quite the same, but 73 in a 50 recently (they'd not long changed the speed limit from 70...), and I feared the worst. But got 3pts and £100 fine - no option on a speed awareness course, however, frankly I was relieved that I didn't get a % of my salary (what with being a powerfully built company Director and all that). First points in 20 years (putting aside two speed awareness courses). The irony in particular was that it was in my daily drive and nothing particularly exciting.

Oh that is such a pain! Especially as it was your normal everyday drive.

I was coming out of a 50 and the 30, completely new area and the sign had been graffitied over, very helpful! Hoping it will just be the 3 points and a fine as the % would be a hefty sum for me too!

I just got the Notice of intended prosecution through and no mention of the speed awareness course. Just said in small print that if i was eligible (not sure what that means) i would get 3 points and a £100 fine. However, google has a very different story.

I got caught doing 52 in a 30 about 10 years ago. Got 3 points and £60 fine.

TBF it was dual carridge way and had recently been reduced to a 30. Although only from 40.

Until they know who was driving, they won't know who the Fixed Penalty needs to be issued to.

Thank you! that makes perfect sense, think i was just in a bit of a panic. it is just that for some reason says on a couple of different sites - solicitors sites - In 'minor speeding cases the NIP will be accompanied by a conditional offer Fixed Penalty Notice' and then goes on to say if this isnt the case contact us immediately - very good marketing that

I got done 87 in a 70, course cut off was 86. 3 points £100 (glad it wasn't 10% of salary as well)

If the sign wasn't marked clearly then you'd have grounds to appeal, but unless you're facing a ban I wouldn't bother. I got caught doing 39 in a 30 in a zone that I've always thought was a 40 zone last summer, I'd been driving for 3 years and got the speed awareness course.

60 in a 40, £100 fine and three points. November. Over by too much for a speed awareness course. Good luck!

Here in sunny Lancashire, the threshold for a speed awareness course is 42mph in a 30mph zone, a policy which many other forces adopt. The threshold for a fixed penalty is up to 49mph in a 30mph zone.

OP, you are looking at a £100 fine and 3 penalty points if you accept a fixed penalty.

Also got done for 43 in a 30. £100 fine, 3 points. 42 and I would have been offered a speed awareness course.

It may well be that depending upon the road you were on, the speed limit sign not being visible due to graffiti may mean the alleged offence can't be enforced

Personally, I would say don't roll over just because you got a NIP. That's what so many do out of fear.

I got a NIP for alleged speeding once, and once I understood the law and challenged them (based upon the laws and certain protocols in place for how speeding gets identified) in the letter I wrote back, then they wrote back to say they wouldn't be going ahead with any action (as they knew that if they went to court, they wouldn't have a leg to stand on and I would have won fair and square based upon the law at that time)

In a 30 limit they will start to pursue you at 35mph, you will be offered a Speed Awareness course up to 42 (if eligible), then 3 points/£100 up to 49, then to court from 50mph.

Are you sure you were driving? Maybe a neighbour had borrowed the car before leaving the country on urgent business...

I got 53 in a 30 a week after the new rules came in. 1am driving home from work following diversion routes.

6 points and £600 fine. Lucky they only counted my basic salary!!!!
