Hello all!

Long time no posts!

Quick query for anyone who may know.

A friend parked their car in Mansfield at lunch time today.

When they returned to the car a warden was walking around photographing them.

Their ticket was a few minutes past but no yellow parking ticket had been issued either on the car or to my friend.

Should they have anything to worry about?

Any feedback gratefully accepted!

Herr Par Kingvarden should have issued a ticket and put it on the car.

The bad news is:

The Transport for London (Consequential Provisions) Order 2005 under Schedule 2 allows for parking contraventions on GLC roads to be reported on the basis of camera information and where a parking attendant is prevented from issuing a ticket.

The good news is:

I am not aware that this piece of legislation has been adopted by Mansfield.

Was the car worth photographing?

The conjunction is important. If it was possible to photograph the vehicle, it was surely possible to issue a ticket.

I wonder whether (and an IPR lawyer could assist here) if one had a design in which copyright subsisted in oneself on the vehicle one could claim - and if necessary seize under an Anton Pillar order - the 'offending' photographs.

I further wonder whether - if the foregoing holds - one could use this to obtain copies of the photographs taken by a speed camera.

All subject, of course, to exclusions for "crime detection and prevention" that may exist in the relevant, other, legislation.

I think it is all part of a wider conspiricy, I certainly can't park anywhere without some camera phone appering from somewhere to photograph my car - probably putting together an ilicit database of my movements...

Maybe they've had rogue wardens and have decided photo evidence of the time cars are left is needed?

He is keen bugger Streaky and ran out of tickets?.

(Think actually this brought it to get at Red Route stoppers from CCTV).

Perhaps the ticket was about to be issued but the driver returned just in time. Here in the City of Westminster PA's have been photographing cars for quite a few months now. I believe it is to prove and justify the car they have ticketed was parked illegally. They also photograph the tax disc as well. However they do usually do it after they've issued the ticket not beforehand. Maybe this PA was honing his photographing skills.

Down here they issue a ticket, then take a picture of it on the windscreen with the tax disc showing, as "proof" of the illegal parking.

As above, maybe your friend was lucky... 2 mins later and a ticket would be decorating the windscreen?

Does this mean that the ticket I was issued with for parking in a bus lane after being captured on CCTV is invalid??????

Added: It was a parking ticket rather than one for driving in that was issued and since its been two months, I'm sure they can't change their mind - withdraw the parking and issue a ticket for driving in bus lane

Another engineer I know was just a couple of mins over in Tothill St London. The warden was at the car when he got back, he asked the warden for a couple of mins as he had to load up. Warden said ok no problem and that was that - he even thanked the warden when he drove off. A couple of days later the fine arrived. The warden had issued the ticket anyway and when disputed the guy was told the ticket was probably taken from the windscreen by kids!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

So DoctorJohn your initial ticket was for parking on a bus lane captured by camera? But you imply you were actually driving illegally on a bus lane? (You checked if any time only applies?)

So what do you do?. There is no time limit like a NOIP requirement for bus lane infringment IIRC. You appeal and say no no not parked. They re check and discover you were driving illegally so they then issue a correct ticket. I would presume that this would be in order. Know nothing that prohibits.

Two months and nothing? Original fine now increased and they could be on the way to County Court for a judgement?

Best left then. I paid the fine on time but was hoping to use your 'no photo's of parking infringements allowed' course of action. As you say, as parked in a bus lane, there'll be one of those winging its way for driving in the thing before the refund makes its way anywhere near my credit card.
Stupid mistake anyway - know it was restricted after 4, was simply under the mistaken impression that it was earlier!!
