76 in a 30?

A friend of mine got caught by a scam van on the A500 (Usually a 50/70 limit depending on where you are). Due to roadworks its now a 30 and she got clocked by a van on a bridge at 76. She has been told she will get 3 points and a 60 quid fine. Am i right in telling her she is probably going to be off the road for a few months?

It *should* be a ban if it goes to court... If she's offered a FPN the sensible advice would be to quietly snatch their hands off

I would imagine it would be a FPN of 3 pts and £60. If she's unlucky and it goes to court then it will be around 6 points.

More than double the speed limit is usualy ban territory.

In a 30 limit, FPN up to 50. Over 51 and it's summons. Bans usually start around 60 on the discretion of Mags.

As a previous respondent said, tell her to pay up and keep her fingers crossed.

The reason I posted was due to someone I know getting done for exactly the same speed in exactly the same circumstances. She got offered a FPN of £60 and 3 points (was a roadwork gatso) but because of her blondness she didn't accept the summons in time, it went to court and she got disqualified under the totting-up process for new drivers, hence the 6 points. Hope this clears things up.

As far as I am aware they treat infringement of a Temporary (Road Works) Order with speed restriction no different than normal speed infringements.

So I would say a Court case is on the cards and possible ban unless hardship can be proved.

....unless there is anything wrong in the signage for the Road Works limit which often happens and not always checked before SCP sets up. Duff signing gives the arguement that limit is not enforceable and a get out.

My mum got caught by a gatso a few years back doing 73 in a 30.

They offered her an FPN...

Does happen.

Hmmm, CoFP may have been offered a few years ago. Call me cynical, but in the 'speed kills' obsessed world of today, I'm not convinced that they would be that lenient..

I hope I'm wrong, though..

I'm guessing this was in the stoke section?, there has been a van down there most days and in all honesty the police have parked it in a area where you can spot it very easily before it starts to record.

It seemed to me it was there to slow people down rather than catch them as you can see it and slow before it can get you!.

from what she said it was where i usually see it parked, on the bridge at the junction of A500/A50/Campbell Road Michelin, just as it goes from 70 to 50 to 30

I saw them there one night at about one in the morning.

I came round the corner off Hyde Park Corner, and was just getting on the power for the corner when I saw them sitting there.

Since they were targetting the tunnel, not the corner (I mean really who would be going *that* fast there).

I got a little *pat on the head* motion from one of the traffic plod at the side of the road.


(it might have meant slow down, I guess)

They do have an incentive to offer FPNs because that way they get to keep the fine money to pay for more ways to rip you off in the future. Also they would have to turn up in court rather than spending their time in a scamera van. So I can Imagine them bending the rules a bit.

But the offender doesn't yet know if she's getting an FPN. If she has to go to court the above would be sensible advice if her licence is important to her.
