The Wife has just returned from a shop to tell me she's receive a Penalty Charge Notice for parking in the supermarket car-park without displaying a ticket.

Penalty Charge Notice
Issued by Control Plus on behalf of London Borough of Hillingdon
£40 if paid within 14 days.

I assume there is nothing to be done except pay, but just thought a quick post here wouldn't do any harm just-in-case.

She's got the receipt from the shop to prove she actually was shopping there and masses of previous pay-and-display vouchers from previous shops there. I assume though that none of these would be any defence as the offence is 'parked in pay and display car park without clearly displaying a valid pay and display ticker or voucher'.

Any (helpful) comments welcome before she pay's...

i've had this before. u usually find a sign in the supermarket limiting parking there for two hours. If you've just used the place as a car park regularly (people who work for me park in the sainsbury's all the time) you end up being targeted. If you were shopping just write in with the receipt. If you shopped there earlier then went elsewhere and came back to the car later then again write in. If this is your first 'offence' as such also write in. This isn't like a money grabbing council scheme and i've found supermarkets to be far more understanding.

The problem is it the Borough of Hillingdon who have issued the ticket and not the supermarket, I assume the carpark belongs to them.

Not much hope sadly...

Who owns the car park? They could just be trying it on, wouldn't be the first time. Remember, parking attendants fake evidence. Did she actually have a ticket for that visit, along with the receipt?

Thanks for all your replies.

I believe the car park must be owned by the council because the ticket requires payment to the council. This does go against previous information I was given when I witnessed an accident in the car park and wrote in as a witness only to be told that it was a private car park and that the council had no responsibility within its bounds!

She didn't buy a ticket on this occasion, although she has many times in the past (and still had some on display). She only shopped at the supermarket and has the receipt.

Seems like on this occasion the only course of action is payment.

Two things you can try:

Pdq have a word with the Manager of the Supermarket complaining of having been issued with the ticket as you choose his store to inject money into by shopping.
He may, and I only say may, have an avenue to get the ticket nulled.

If the Council are involved then check their rules and regulations on this matter to see if you have a line of appeal up to and beyond the LA to the Parking Adjudicator and take that route.

If Car Park is Council owned, the charges have to be clearly signed. Check this. Also check with the Store Manager as to who owns the Car Park.

A good delaying tactic, if the Car Park is Council owned is to Appeal against the ticket. This can delay things by 2 or 3 months. And if your Appeal is upheld, eg if the Parking Charges were NOT clearly shown, they should cancel the ticket.
