He has been sent a NIP for doing 37mph. ( I am suprised his car is not just a blur in the picture at that kind of speed :rolleyes:)
Anyway, he is financially challenged and thinks his best bet is to let them take him to court so he can make an arrangement to pay rather than being hit with the full £60 in one go.
I think the fine might well be higher if it does go to court so that won't help him much..
Should he request the video evidence or whatever in the off chance they can't produce it.
Can you ask them for the evidence and then plead guilty or if you ask for the video are you pleading not guilty?

If several drivers could have been driving at the time, and your uncle were unsure of who was actually driving, he could ask to see the photo. It may or may not be provided, and may or may not show who was driving.

Unless there is some convincing evidence that he did not commit the offence, which does not seem to be the case, then the Conditional Offer will turn out to be the cheapest option but as far as I am aware there is no payment by installments like a cOurt fine.
Taking it to Court could result in a higher fine and most certainly, as stated, CPS will want their pound of flesh for appearing which varies about the Country £30 - £60 extra - NG or G matters not.

There is one thread of hope...Get him to check that the summons clearly states that it is issued at the behest of the Chief Superintendant of Police of the issuing Area and not merely from the Director of the Safety Camera Partnership. If it is not authorised by the CS, then it is a pointless document with no legal implications whatsoever. Full details of this and other Greed Scamera cock-ups can be found at www.ABD.org.uk

I have just spoken to my uncle again.. he has been taken to court for speeding before and got away with it!
He says he sent the nip back without signing it and when he showed up at court they asked him how he was pleading, he played the confused old boy !
Judge: How are you pleading mr X?
Uncle: How am i pleading to what?
Judge: To the charge of speeding!
Uncle: Speeding!? When? Who says so?!
Judge: You are here to answer to a charge of speeding, you were caught on camera!
Uncle: Was I really? Can i see what evidence you have to support this? I have no idea what you are talking about!
The judge then asked the CPS guy (or who ever was there) for the evidence, but they did not have anything to show!
The court case was adjourned and then exactly the same thing happened again, but with a different 'prosecuting' person present
My uncle just carried on looking bemused by the whole thing!
They said they could probably get the evidence faxed over if he could wait, but after two more hours no evidence had been found to support the charge and the judge threw the case out
I think he is going to try that one again!
