Hi

I have owned my boring car (Diesel) since 28/7/05.

Today I get a letter from the Safety (S)camera team, requesting that I supply the name and address of the person whom I bought the car from.

Now - am I obliged to do this? I don't have his details any more (might find them, not sure), but this is a few months ago, and since I had the new V5 have chucked away the directions I used and all his details. He wasn't the registered keeper of the car either.

Now, (and this is true), I saw the car on eBay and arranged to meet him in Bedford (I live over 150 miles away) so this was easier than finding his address. I made him an offer subject to it being HPi clear which I said I'd check the next day before any cash was exchanged. He was fine with this and I had a trader freind check it out for me - it was all ok. I picked up the car 28/7/05, which is when I Taxed it (at the post office when I filled out the V5).

Where do I stand regarding not having his details?

I know of no law requiring you to identify someone other than the driver of a vehicle at a time when you are the registered keeper.

Suggest that you write back stating that this is an unexpected and unusual request to receive from them. As them to clarify the act and section under which they require this information from you.

I wouldn't even bother stating you consider their request unexpected or unusual. In much the same way that they wouldn't consider your opinion if you got caught speeding while traynig to make way for an emergency vehicle.

Ask for the Act of Parliament. Maybe advise them future letters will incur a £25 administration fee.

Suggest they go and spin on something. Nosey ba$tards. Suggestion above for an administration fee an excellent idea though, but a little higher I think.

When SCP identify an offence of speeding then they have the clout of S.172 (name and shame) RTA 88 to get to the driver. Not only can a request be made of poor old Reg Keeper but also using a request made by or on behalf of the Chief Officer of Police on ANY PERSON who SHALL if so required give any information which is in his power to give and which may lead to the identification of the driver. Failure to do so IS AN OFFENCE.

So my friend I would tread very carefully least you get stung. You may wish to consider sending a carefully worded reply outlining the facts as you have done above.

Yes S172 2b.

"any other person shall if required as stated above give any information which it is in his power to give and may lead to identification of the driver"

If the CC thinks it will help you have to tell them.

So I'll be phoning them today.

I can only tell them what I know, which is his first name (from memory), and that he lived somewhere in Bedford.

If they had contacted me sooner than almost 3 months (I got the V5 within a few weeks) then I'd have been able to tell them the lot.

However, I have read that it is up to the registered keeper to notify of any changes. Therefore, anything surely falls to the responsibility of the LAST registered keeper and not me???

Does the link to the eBay auction still exist? Might be an idea to include that in any correspondence.

I would have thought the stupid bastards would have gone to the DVLA 'err' thats where all the records are kept dumbos!!! I don't suppose one has to have a very high IQ to work for a Scamera Partnership, but perhaps it would help to have a little bit of common sense and at least half an 'O'Level.

I can't imagine why they want to know who the previous keeper was, or why they decided that asking you was the best way to find out, but it appears that they're entitled to ask you in which case you're obliged to tell them if you know. Given that the name and address of the previous keeper is recorded on the V5 you clearly do know it so there is no valid reason not to tell them.

Just to clarify, the guy I bought it from didn't have it in his name.

Therefore the person whom I bought it from differs from the V5's previous "registered" keeper.

I would have no probs in supplying this info, but disposed of it since I received the V5 from the DVLA, in my name.
