Now that Parking Offences have been Decriminalised, a lot of Councils have set up their own Parking schemes, the thing is with these though, is that the ticket is sent to the Vehicle Keeper and not the Driver at the time the offence was comitted, but what if as in my situation where both the Wife and I have our own cars each is registered in our own names............
Now as my Wife often uses my car, imagine if she gets a Parking Ticket and I get the Fine in my name (as keeper), when I know for definate I was not the one commitng any offence as she was using the car when she was booked!
The long and short of this is that she commits the offence, and I get the fine, how on Earth can someone be Fined without commiting an offence?

Cos that is what the law says and places the responsibility for parking fines irrespective of who the driver was on the Reg Keeper. It is such a good earner that I am surprised they haven't extended this to speeding offences where there is dispute as to who the driver was???????

I suppose I would just pay up then...................., then take the Wife to the small claims Court to get it back

DVD, are there any other Offences you know of for which you can be Fined without ever having committed that Offence?

Try talking to the Licencee of a Pub. he could be miles away but under vicarious liability he gets nicked for some offences committed by his staff.

exits left singing "what a wonderfull world".....

You might like to know DVD that in Sweden this is exactly what they've done.

Back in the mists of time they tried front facing cameras, and people drove with their visors down. Upon receipt of the equivalent of a S172 the replies tended to be along the lines of advice regarding sallying forth with the purposes of increasing the population.

Anyway the cameras disappeared and hand helds ruled the day.

Now the law has changed and registered keeper gets the responsibility for paying the fine regardless.

Now what I hope is that because that country has a very well developed system of collision recording it will be interesting to see the effects in a few years.

Thoughts for today;

The law's an ass and the people making them are arseholes!

The people upholding these said stupid laws are -wits.

People breaking these laws and paying up without a fight are dumb.

People who voted in the present government are even dumber.

Under a new parking enforcement regime, introduced in Rochdale in July last year, penalty charge notices should be issued to the owner of the vehicle. But the council has continued to issue tickets addressed to the driver. Mr Freeman said anyone who has received the wrongly addressed tickets should be refunded.

I wonder how many other such schemes are also flawed?, does the word Floodgates come to mind

I seem to recall reading earlier this week of an authority enforceing the Special Order when in fact they had not been granted the Order. In a senior moment the name of that authority escapes me. Meant to make a note but a curvy piece passed the window. Sigh.

Where will they draw the line here?

If your car is used to run over and kill and queue at a bus stop will they send you to jail instead of the driver?

Easy to administer it is, but justice it isn't.

I would think that that is actually the way the law stands now, if you can't prove you were not driving.

With all this, doesn't it strike you as laughable that they can't get a charge of Corporate Manslaughter to stick!

One rule for the bosses and one for the "proles", perhaps?

since when did you have to prove your innocence in an English Court of Law?, innocent till proven guilty, (beyond reasonable doubt as well), the last 1,000 Years of Martyrdom have won us this right and NO ONE is ever going to take it away either

You don't get done for driving without a Driving Licence until YOU PROVE you have one......
