Now before I start can I just say that I love TVR cars, but......

Putting down a deposit at the Motorshow 2 years ago for a new Tuscan MKII Convertible seemed like a good idea at the time. However due to a change in my circumstances I decided to cancel my order and ask for my deposit back.

Now firstly I called TVR (Blackpool) and I was told that the deposit was not refundable. LIE!

After further investigation/conversations with various people I found that the deposit was indeed refundable and so I wrote to TVR, once, twice, three, four times and more asking for my refund........I heard nothing, not a sausage, not a whisper!

In the end I put in a claim with the small claims court. They didn't even bother responding to the court summons and so the courts found in my favour. Eventually after bailiffs had been instructed a cheque arrived on the doormat for the amount plus court costs owed!

Absolute genius TVR, well done! A* Customer Service.

No, but that was my fault as I didn't include it in the claim. I should have done really.

I even wrote to them telling them I was going to take them to court in 7 days and they still didn't bother to reply!

How so then? Not that i'm knocking you you understand, but i thought that the deposit was a financial show of commitment to purchasing, and as such, that tvr would never have HAD to refund it.What are the consumers rights here then?

I thought this was the case too - certainly I put my deposit down on the Sagaris at MPH 03 with the understanding that if I decided not to go ahead with ordering the car, I wouldn't get the money back.

A deposit is refundable unless the paper work you sign states otherwise. Also a deposit is refundable no matter what you sign, if you can prove the otherside has borken the contract.

That sounds very arrogant (of TVR).. I guess it must be Ostrich syndrome.

From the past - I remember quite a few putting down deposites for TVR's but the car they often produce looks nothing like the show car - so most could argue that it was not what they put their money down for !

I recall a big song and dance when the deposits went non-refundable, was that last year?

It's possible that when they weren't refundable before that, the paperwork wasn't legally correct or it simply wasn't stated, so despite the fact the money was already in their coffers, it was legally still for the depositeers.

So if a deposit is easily refundable and has to be(legally) - what is the point of taking one in the first place?

It sounds like a complete waste of everyone's time

What are you all moaning about!? NS has saved TVR, there's a new showroom in London, there's a new factory on the way, warranty and new models plus 20% increase in production....

I'm sorry....so you think that it is perfectly acceptable for TVR to not reply to repeated letters from a TVR owner who decides they cannot go ahead with a new purchase?!

I think you might just have slightly missed CWS's ironic humour there.

Put it this way, I made sure the cheque cleared before I posted on here just to be on the safe side, so pretty recently. Let me know if I can be of anymore help Plotless.
