I posted a while back about the motorbike accident I had.

Basically all witnesses agreed other drivers fault, driver in a round about way admitted liability.

Where do we stand insurance wise where the driver (and his company with whom the insurance is through) is not responding to their own insurance companies request for a statement. our insurance company is basically they will not do anything at this stage and may decide to settle without prejudice even without getting statements from the witnesses. Can they do this even where clearly the other drivers fault and they will not respond.

Where do we stand? This cannot be right surely our insurance cannot settle a claim in this manner.

I had a similar situation a few years back involving someone who drove into me, but would not communicate with his insurer. I used my uninsured loss cover to obtain a CCJ against him, and eventually his insurer coughed up.

Said person/Insurers can be sued direct under The European Communities (Rights against Insurers) Regs 2002.

Usually, if the other party does not correspond with their own insurance, eventually they will pay out, after writting to him and saying that without his feedback, they will admit responsibity on his behalf, affecting his NCD etc, unless he replies within so many days.

Obviously they may not do this until a few months have gone by.

Sue the wrongdoer in the small claims court for all the costs you've incurred. He/she'll crap themselves and get their insurance company to remove their fingers from their arses.
