According to yesterday's local rag, the nice men that leave love letters on windscreens of cars are being a bit naughty.

It seems that they are parking for the day on single yellow unbroken lines and then fining other motorists for doing just the same.

According to a council spokesperson 'they are carrying out a statutory duty on behalf of xxxxx Borough Council as as such are exempted from our traffic regulation orders while carrying out thier duties'

Is this correct? are thye exempt from the regulations like this?

(bear in mind, these are the same people that ticketed a bus at a temporary stop and an ambulance on a 999 call!)

The yellow lines are brought about by the Local Authority applying for and being granted a Traffic Regulation Order (No Waiting).

Like many Orders there is generally an exemption to those engaged in the Emergency Services to park without fear of getting a ticket. Generally worded as far as Plod is concerned as "for police purposes".

One should view the actual No Waiting Order itself to see exactly what the wording is and who is exempt.

An interesting point is the fact that if Parking Attendant is employed by Local Authority then it may well be that that LA has applied for and been granted an Order under Road Traffic (Permitted Parking Area and Special Parking Area) Order
which under Part 3 Road Traffic Act 1991 decriminalises waiting on a double yellow and passes enforcement from Police to Local Authority. As decriminalisation has occurred can they claim "for police purposes"?. So an infringement if their attendants park to issue a ticket on a yellow?????????

As I say it will all depend on the wording of any exemptions within Waiting Order.
