To all you knowledgable folk out there in PH land.

I'm after some advice for a work colleague of mine, reference an insurance issue he faces.

He recently had an accident on the M1, where he spun on some standing water and hit the central reservation barrier writing off his car. Both driver and passenger were thankfully OK. No other vehicles involved.
He is fully insured but has just noted something regarding the documentation his insurance company have asked for post the accident in order to process his claim.
They require his drivers licence which now has 9 points on it, but had none when he first started his insurance with them some years ago. He has (stupidly in my view) just renewed with them everytime the offer has been made without ever telling them of the points he's collected along the way.
This has now got him very worried as both he and I can see this as a perfect opportunity for his insurance company to get out of paying up.
However, another colleague has said that something similar happened to him, but he was allowed to pay the extra premium on his insurance policy post the accident for the extra penalty points he'd accrued during the life of the policy, in order for him to get the insurance payout he was waiting for, but I understand he had to argue very hard for this.
How should my colleague proceed?
Any HELPFUL advice gratefully received.
Yes he's been a right dick, and with hindsight he accepts it was silly of him to just renew in that fashion.
I will try and answer any questions but my knowledge of the incident is limtied.

It will be at the insurance co's discretion I think.

The reason they're asking for his license is to determine whether his details are correct (now that they're possibly going to have to fork out for a large claim). He'll need to be prepared for a nasty shock.

Indeed. If he's willing to take the risk of being uninsured at claim time, he may as well have not bothered paying the premium at all and taken his chances for free...

Thanks for the advice, my view is also he will just have to see what they say. He claims he just renewed every year because they never asked if he had any motoring convictions year upon year. I guess he needs to read between the lines of his contract to see what it says.

I'm not sure that the wording of his contract will necessarily help. As I understand, the duty to disclose items that affect risk is enshrined in law. Sounds like a case of disclose and await what the insurer says.
