Just driving home from work and noticed two bright yellow jackets in the distance, turns out to be two policemen with a speed gun. I was doing just over the 40 limit probably up to 45, one of them pointed at me but didn't flag me over to stop. Can I still be done or do they have to stop you to issue a ticket?

Nah you'll be fine. If they were by the road, chances are that they'd have stopped you there and then.

your within the 10% + 2mph rule, so I wouldn't worry too much

Not always.

And the 10%+2 is no longer a guarantee.

Nonetheless, if your speedo said <45mph, your actual was probably 43/44, so you've a fair chance of being ignored - they probably check everyone they can.

Your Scooby should be. My 'teg was about 2mph out at M-way speeds, and the Focus and S2000 are supposed to be even closer.
