I have just had a NIP from Northamptonshire doing 78 in a 60 zone.

I hold my hands up to it, but is there a way of getting off? I believe the Human Rights thing has been overturned and can't be used any more. Any other way?

The human rights thing is a dead duck. The 'I don't know who was driving my car' line is not valid unless you're plod.

Taking the rap is what you'll end up doing. It'll likely just be 3pts and 60quid. Not worth fighting with spurious arguments unless you're facing a 'totting up' ban - magistrates are becoming increasing despairing of motorist turning up in court and blathering about calibration of equipment etc and we're seeing a corresponding reduction in the level of sympathy from them.

However, so many people are getting caught - especially in honey-pot areas like Northamptonshire - that myself and others here (Hi NoneGreen ) are advocating that everyone caught should to court instead of accepting a fixed penalty.

This way, owing to the sheer number of tickets issued, if everyone refused the fixed penalty, the system would become so clogged and underfunded, it would collapse.

Either that or you'll be assigned a court date in 2012 !
