You've clearly misread/misinterpreted both the article and Whitmarsh's earlier comments wink

Present at Sidley Austin LLP, a London law firm - an alternate venue chosen by the FIA at short notice due to the Paris transit strikes - were representatives not only of McLaren, BMW and Williams, but also Ferrari.
What on earth are Ferrari representatives doing there? This has nothing to do with them.

Big Mac's lawyer said:
It must be right that if the team is disqualified, the driver loses the points as well.
Er, does he not see the irony of this one???

The McLaren drivers were offered immunity from points deduction, if their team received that, in return for providing information about the spying stuff. If constructors' points are removed, so ordinarily are drivers' points.

Let's hope their lawyer is better informed than he appears, having apparently forgotten about the last time (IIRC) there was a fuel irregularity*. Brazil 95, Williams and Benetton fuel samples from after the race didn't match those from before it - end result was that the teams lost their points but drivers kept theirs.

* The BAR thing being a weight irregularity, rather than a fuel one?

The FIA attend all these hearings. Why should this one be different?

He'd be a rubbish lawyer if he didn't ask for that!

Or perhaps you're worried you won't be able to claim Lewis 'chocked' (sic)? hehe

i am not worried, KR won more races than LH fact, if the points system was more like in the Moto GP then there is more reason to win a race than finish secound or third. If LH wins then it must be nice to say you had a lawyer win you the title, its a bit like being a kid if I cant win myself I will get my dad to help me win with that ever it takes judge

What happened to the original plan that three independent judges would make the ruling. Is this still the case.

nono

If Williams and BMW hadn't cheated in the first place, LH may have finished higher up at Brazil and therefore would have won the Championship on the track.

If LH is granted the championship retrospectively, there is nobody to blame but BMW and Williams.

The fuel temp variance in question in the BMW and Williams would not have made any material differnce in their performance - and LH would not have overtaken them had their fuel temp been 3 deg higher at the point of refueling.

No chance of LH catching either BMW or Williams in question on the day.
