How long to wait before getting shirty.....

Long story short, bought a used RRV8 from a certain dealer in Bucks at the end of Jan and noticed a definite "clunk" from the gearbox on up-shift. Took it to my local dealer, who confirmed that a new gearbox would be needed. No probs, I think to myself, that's why I bought from a main dealer as these things will be fixed under the LR warrantly. Warranty people then say that as the fault was there on the day I picked the car up, it is the dealers responsibility to fix. Call dealer, book it in & they also say a new gearbox is required.
This was 4 weeks ago, during which time they have had the car sitting at their premises (albeit, they gave me a Volvo S40 as a courtesy car) and the gearbox still hasn't arrived at their premises for fitment.
Any views on how much longer I should leave it before rejecting the car back to the dealer & asking for a refund (indeed, can I do this)?
