alright all

been trying to get money out of someone that has owed me it for about 12months now and still refuses to pay , i have sent letters recoded delivery etc to his home adress asking for payment .

now i am at the end of my whits end as its a joke , i have told him am taking him to court for the money as been trying to get it out of him for te last 12 months with no joy .

his buissnus is half legit half not regarding tax man, so thought last thing he would want to do is go through all the hassle which i would rather not either to be honest . i left working for him when i later found out that i was getting charged tax natniol insurance etc but i wasnt actualy on his books he was basicly just paying cash to me as, due to it was easy that him setting up all aconts etc which was fine by me , i have said will talk to the tax man and have got witness etc

now he has decided after months and months of me trying to get the money out of him , that i have supposdly broken into his van , which is under cctv and is all alarmed up all dead locked parked outside his house etc

now i have been sent a few threatning text messages telling me to go see him so we can sort it out before he finds me , also tells me that he has pepole after me and to watch my back because my time is limited , saying come see me before i find you etc

now am thinking this vilont behaver is down to the fact he has got nothing else that he can try and is backed up into a cornor .

what would pepole say the best route to take

many thanks and sory about poor english

How much money are we talking about?

You can claim the money from him via the internet here.

https://www.moneyclaim.gov.uk/csmco2/index.jsp

Are his threats just talk or not? If not then I would contact BIB.

Good luck.

If it was me I would do 3 things:

1. Visit the local DSS office and explian that you were, so far as you were aware, properly employed by xxxxxxx from yyyyy until zzzzzzz and that you want the DSS to confirm that NI and PAYE have been properly deducted from your take-home pay. Quantify the amounts of take-home pay you received and the dates on which you received them. That way, any shortfall won't effect your pension, as your former employer will have been legally liable to have paid it. You need to confirm to the DSS that you worked as an employee. To do that you must have been employerd in an on-going financial relationship. That is, you were paid hourly, weekly or monthly rather than as a sub-contractor who put in pre-quoted prices for set amounts of work and that your employer had the right to direct, control and supervise the work you did and the way in which you did it on an on-going basis during your employment period.

2. I would visit the local 'Old Bill' and explain that you have been threatened. Make a formal complaint and explain your actions with the DSS, which they can confirm if they wish.

3. Put a County Court Writ on your former employer via the small claims procedure. You can actually do this on-line these days and the summons is issued by the courts. The cost of doing this is around £35 for the court fee up-front, but when you win you normally get costs awarded to you. If the person owing then does not pay you put the bailiffs in to collect the amount owed, or goods to that value.

That should sort it.

he was paying me cash due to the reson it was easy than him putting it in my bank acount , to my knoledge i was paying tax etc as was employed by such person later to find out he was ot doing things by the book , hence why i left and seeked other employment elsewhere .

i was not subcontacting to him due to the fact he would still have paper work to prove this i was defanitly employed by him on a full time basis as anyone else would be,

him paying me cash was easyer all round due to him not having time to get to bank due to working long hrs
