A friend of mine has moved to the UK from Italy. She has been riding a 125cc scooter on her Italian driving licence.

Does anyone know how long she can do this for? Is it 1 year?

If so what is the process after that year? Does she have to take a UK driving test to contunie riding, will she have to take some sort of motorcycle test or can the Italian licence be swapped for a UK one?

Yes, if the licence is EU approved she can use it in any other EU country until she turns 70.

Great, thank you. Only she was recently stopped by BIB and they implied that if (after 1 year) she was still on the Licence issued in Italy she must have gone home for at least 6 months since she first started driving here.

They should know better, BiB's that is.

I have a Swedish licence, EU approved, that I can use all over EU until the day I turn 70.
I also have a Finnish licence, which is not EU approved, meaning that I can use it only for a limited time in the EU, after that I would have to change it for a EU licence, in the country where I reside at the moment.

That used to be the case, I passed my driving test in Italy and then moved here and had to take a UK driving test within 12 months, shortly afterwards they started to accept EU licences in 'exchange' for UK ones but this was some years ago.

Incidentally my Sister did the opposite (passed test here, moved to Italy) and the Italian authorities simply gave her a licence on seeing her UK one and let her keep the UK licence.

Residents

If you have a valid community licence, this will authorise you to drive in GB for the period set out below. Alternatively, you can exchange your licence for a British one at any time.

Provided your licence remains valid you may drive in GB:
Car, motorcycle driving licence holders (ordinary driving licence):

until aged 70 or for three years after becoming resident, whichever is the longer period

Slightly OT.

In Italy you used to get automatic bike licence when you passed your car test.

A few of my friends, simply "moved" to Italy, swapped their uk licence for and Italian licence, then "moved back" and got their Italian bike licence added to their UK licence.

If people ride or drive on say an Italian Licence.....how do you add points ??

Or do they get away with it ??

As long as it's a legal EU approved licence, that licence is valid in the entire EU yes

Ok so the dvla set up a ghost licence and you get to 12 points or more with it and get it suspended, can you still drive with youre EU licence as the courts have no right to take that one away from you. Or is it the person that gets banned from the road as opposed to not having a licence.

Then the person says , yes but I am driving on my EU licence as I am entitled to under EU law....

What does the BIB do ?

Arrest them ?

Charge them ??

And if so with what ?

And can you or the courts take away that EU licence ?

If you are disqualified from driving you get arrested, charged & put before the court, for driving whilst disqualified. If a court has disqualified you from driving then it doesn't matter what licence you are physically holding, you can't drive here until the disqualification period has ended.

You can be guilty of disqualified driving whilst holding a valid licence, the offence of driving without a licence is a totally separate (& less serious) offence.
Driving whilst disqualified is breaching a court order not to drive in this country.

But the licence is valid in all of EU, I very much doubt any other country can give you a "virtual licence" and put points on it, and then disqualify you from driving, without actually taking the valid licence from you. It doesn't really make sense.
The police in Sweden can not take a UK licence, it has to go to court in Sweden and after that it's the UK embassy/authorities that will, or will not revoke the licence, not the Swedish authorities.



Just out of curiosity, why is it a less serious offence if a druggie who has never had a licence in his life drives, than if a guy with a 2 month ban drives? The logic would be that the one with the licence, even if revoked at the moment, actually has a legal right to drive, and has had the required lessons and education for driving.
