a friend of mine showed me her new car today. its a 08 plate corsa bought from bristol street motor point in widnes.

i was horrified after looking round it to find overspray all over the place, orange peel, runs, contaminants in the paint and even masking tape still on the roof gutters !!

here's the panels ive found that have been very very badly painted

roof
both bumpers
driver side rear 1/4 all the way to the a post
drivers door
drivers front wing

obviously she wants to return the car and we are going to go in tomorrow but what are her legal rights ?

any advice greatly appreciated but please please dont post any thing unless you know its 100% fact

already got lots of photos and going in to see the after sales manager tomorrow afternoon

im quite prepared to stand outside handing out flyers saying whats happened to anyone coming in there if they dont play ball

But what have they done wrong? Did she pay top money? The paintwork is not very good in your opinion, but not hers as she didn't even notice when looking at the car...

and thats the problem as in theory shes looked at a car, said she liked it and bought so they havent done anything wrong

its only when the paint has been pointed out that she realises shes got something worth about 40% less than a decent equivalent car

A family member had a similar experience on a slightly older car from a well established dealer who's first name might be Arnold , they eventually agreed to have the paintwork professionally re-done so that it was much less obvious repairs had taken place. Refund or replacement was never an option.

What do you expect? The only legally binding 'return period' that i'm aware of is the distance selling act, and as your friend saw the car in the 'flesh' and made the deal in person, she hasn't got any recourse. Unless the dealer said to her 'this is how the paint comes out of the factory' ie. he missold it to her, I think your only option, as said above, is to go in and talk to them and get an exhange or a bit of money off.

I think you'll find if you go in all guns blazing demanding a full refund, they will politely tell you to fk off.

Sorry. What I meant was she has no rights to a refund simply because she has changed her mind.

Was it an 'approved used' type car? If so they normally have certain standards which the cars have to meet, which this one clearly wouldn't so there should be some kind of comeback. However if it was just a regular used car you're reliant on goodwill.

you have a recourse with any major mechanical fault surely there is something for the condition or hidden baddies


I feel for her mate, hope she can give it back or at least get it painted and mopped professionally.
