Hi guys,

My tenant has stopped paying the rent and is clearly extracting the urine, anyone any ideas how to recover ?

I am in the UK and my apartment is situated between San Pedro and Estepona

Ooh er. It's a bugger to get them out legaly. Takes months.
Although I heard the laws have changed recently, to make it easier.
The problem is getting court dates. You will have to go through a Lawyer to get "juicio de desahucio".
Forget recovering lost rent.

I'd be inclined to get the locks changed while they're out. Although they could call the Police, and get you arrested!

I had a similar problem in U.K. (Revrse of yourself, as I live in Spain.)Sent some scary looking blokes round to change the locks.
All the letters I'd sent, and had no reply to, where piled on the coffee table. The place was minging.
I got a solicitors letter, but ignored it.
Three months later, I filled three skips. Never heard anymore from the scum.

indeed the law has changed but nothing has changed in reality,it is a complete arse to remove tenants and horror stories abound-sorry.i was thinking of renting out a few properties and speaking with an agent yesterday about exactly this.there is a rent guarantee with some bold claims-for €90 they say they can with their specialists lawyers and team in madrid remove bad tennants after 2 defaults on the rent.don't wana try myself tbh but happy to get the full sp and post up the details.

What hacks me off is the amount of time I have wasted chasing him for payment and listening to his BS excuses and deluding myself that he was going to pay.

How about I cancel my DD payment to Aguahest they will cut off the water supply and he is fooked ! or hire some heavies as suggested any volunteers ?

True, always around just have to ask around.

Your court case could take years if it is Estepona, took me 9 years to get a case to court there, so I had to sort it out myself as above.
If the case goes to court in Marbella then it is quicker because they have permanent judges as opposed to judges who are on a circuit and I was told never get to the bottom of the list.

You should only ever sign an 11mth contract anything more than that and you will have problems, 11mth contract gives them no entitlements.

Top Man that is what I would do, be careful that if they are Spanish that they don't go and get another contract using a bit of "Enchufe"

I know a fella, who told a bad tennant he was going to fit new windows, so the tennant let them in to replace the windows.
They took them out, and never returned with the new ones. biggrin
The tennant didn't stay long after that.

Quick one for you.

My tennant stoped paying, 2k per month. I ended up in the custody of Guada Civil for 2 days for BREAKING AND ENTERING and i court. To be fair once i went down the legal rout i was back in the house minus the rent money, no chance. total cost 30k !!!!
