Not me driving obviously, circumstances are a family member was at a friends house party and long story short his hire car car keys were taken by one of the friends friend without permission but my cousin is now being summoned to court for speeding even though he had filled in the form that the police force had sent for the drivers information. Is he expected to prove he had returned the said form or is it as simple as providing a statement of truth by post to the court or is it best he attend in person (he is away from UK on holiday)

Here's a test for the Op to see if he is real and a Claims Manager as per his profile. What impact did the Consumer Insuramce act have on Utmost Good Faith? Simple if he does the job he claims, less so if he doesn't.
Read my post again, like I said he is being summoned to court for speeding, I presume he is being summoned because the police force did not get the post which he had returned and how does me answering your question prove if I am a claims manager or not.

If your not going to help in answering the question then there is no reason to add other comments!

Summoned for excess speeding, he said he called the police and they said to discuss with the court now that he's been summoned.

People come here to help one another, whether it sounds fishy or not,who gives a sh*t if people make spelling mistakes.
You can still understand the questionn, Now that I have time to respond let me tell you the circumstances.

My cousin is 25, it was during the day they had a BBQ party rounds a friends house, jackets keys were left in the house, one of the guys took the car to the shop to get stuff for the BBQ,
he took my cousins car as it was blocking the rest of the cars on the driveway, he took it without his permission but my cousin does not want to go down the route of saying he stole it etc as it was returned.
I assume this is an issue between my cousin and the hire company regarding who is allowed to drive etc. My cousin did fill in the form to identify the driver but the police are saying they never recvd it so that is why he is being summoned to court.

The guy who drove the car supplied his details incase my cousin found damage to the car and my cousin has zero points on his licence.

The summons is for speeding not for failing to supply the drivers details, when he goes to court is it as simple as telling the court he returned the drivers details to the police and as he did not hear anything back from them he assumed the police had all the information they required?

All sorted the police did receive the returned form but had had sent it to court in anyway, the court were informed by the police but never bothered to remove it from their system
