Long story short,

Dropped truck off for inspection, given courtesy van, on way home some specimen over takes on a blind bend crossing 2 solid white lines.

Basically I moved over as mush as possibly but we still side swiped as such, vans a write off. I was doing 50 he "claims" he was doing 70..........

Right im a lorry driver ive had to have (so far) 2 weeks as yes that old chestnut of whiplash etc, mines more to do with not having full movement in right shoulder, back at the clinic on Thursday.

So that horrible word my "claim" can I use my car insurance legal cover to sue his ass, or have I got to instruct a No win No fee type outfit.

Only people who can answer the question are your insurers.
The courtesy van, is either covered by our company insurance or the place that owns it.

That was confirmed to the police on the side of the road as I had no idea.

So no I was not driving it on my policy.

Will be ringing my insurance tomorrow to find out but just thought id ask on here to see if anyone else had been in a similar incident.

I don't know as ive not looked and the policy documents are at hime and im 130 miles away.

Not my policy for the van as it was company business, it will be my personal claim. just got backfrom Sunday lunch so will ring shortly.

Either way, it should be open-and-shut. His insurance will be picking up your tab. Whether that's directly - because you claimed straight off them - or via your insurer depends on whose claim form you filled in and returned.

Legal cover shouldn't come into it, because there shouldn't be any need to get a court to decide who was to blame. The nugget overtaking in a mind-meltingly stupid place was.
He was overtaking cars coming towards me.

Im 130 miles away due to already having this week booked off to come to the MILs to sort out the deceased FILs estate. (2 weeks sick is up on thurs)


And gc8 if I could be bothered to get photobucket etc etc id upload the pictures of said van.

Im 38 not 8.

And the police took all the details and he said due to "shifts" id not hear anything for 8 to 10 days.

Sorry for my ignorance but I asked advice as its a situation ive never had to deal with.

Apologies, heads a sieve, FIL couldn't just have all his eggs in one basket, im sick of paperwork.


Right ive had the crime numbers from the police and the company that numpty was insured with, upon speaking with them I have to lodge my claim thru who ever pays for the policy on the van.

My transport manager is away on business till the morning so that's put an end to that for today.
