My Wife has received an NIP from North Yorks Police intending to issue proceedings for:
- Careless and Inconsiderate Driving
- Fail to Stop and Report Accident

Given that the alleged incident was in a car park (detailed on the letter) this seems somewhat disproportionate and has got the Mrs in a bit of a stress.

Any thoughts / advice much appreciated,

Tia

P.s. if there was an accident she didn't notice and I'm about to check the car!

Any damage?
Not that I can tell. It's a 10 plate Tiguan and has the odd mark anyway.

TBH if she has bumped something and not realised but someone has seen that's absolutely fine. I will let the insurance do the job we pay them for!

It seems a touch extreme and she's worrying so I thought I'd ask what you guys thought.

surely your wife knows what happened. there must be a witness.
There's no detail on the NIP and as far a s she's concerned nothing happened. I suspect a busy body (3rd party) 'thinks' they saw her bump a car while parking.

She's got a simple choice. She can tell the truth and say she was, then later deal with whatever charge she might get as a result - including denying it happened... Or she can lie and say she wasn't.
Not quite sure I follow...

Edit: all of your post not just the quoted bit.

why are the police involved in a civil matter, besides bump and run, the witness must be important? Has there been an insurance claim?
Not a clue. And no claim.

It's very odd.

A NIP is simply asking the RK who was driving at a particular time and place. No more than that.
Oh. Agreed.

The concerning piece is intending to issue proceedings for:
- Careless and Inconsiderate Driving
- Fail to Stop and Report Accident

When as far as we're concerned nothing has happened.

Does that make more sense?

Sure, but that's not what she's being asked now. That's the next step... She might be offered a half day of tea and biscuits, she might be offered a fixed penalty - both of which are saying "Yep, I did it". Or she might be offered the chance to deny it in court, and present her evidence against whatever evidence the Police might or might not have.

But, right now, she's ONLY being asked if she was driving that car there then. So she can say she was - the truth - or she wasn't - a lie.
Cheers

I assume she was in that place at the time as well?
She was.
