Rear Ended - Options?

A delightfully aggressive chap decided to deliberately rear end me whilst I was stationary in a residential side road whilst I was puling out onto a junction after I decline to fight him. He apparently took exception to me or my car (genuinely, I did not call him rude names etc.)

I spoke to my insurance company who have his details and have checked he's on the MID. Now my insurance company have decided my car is a write off. They would spend £5k repairing it but only offering £6.5k as a payout (less a £1k excess which may be recoverable using my motor insurance solicitors)

To replace the car would be nearly £9-£10k.


I reported this incident to the police who are yet to talk to the third party. He sped off without leaving his details and I suspect he may have been drink driving.


Now I'm wondering if I should be claiming from the third party's insurance? They are supposedly 'investigating' which could take weeks. As far as I'm concerned, it's a no brainer - he hit me in the rear, deliberately no less.

Can anyone offer any advice as to what I should do or where I should claim from? The TP insurance are still trying to establish liability as the TP has written some kind of statement which I suspect has a different version of events (what this may be, I'm not sure?!)

I see some people suggest an accident management company but all I want is to be put in a fair financial position as this was NOT my fault in any way.

Any help is appreciated, in all my years of driving I've never been in a motor collision.

Thanks all for the advice.

Believe it or not, (as this is PH, not is most likely) this guy was seriously unhinged and seemed to be intent on fisticuffs for no apparent reason. Perhaps he wanted to try to write his car off, I don't know.

Mine came off significantly worse though, however I may have an option to repair it at a reasonable cost which I'm exploring at the moment.

Despite this I'll end up out of pocket I'm sure. Good way to start the year.
