Photo on licence expired, an i legal to drive

Have just noticed that the photo on my licence has expired, looked on the DVLA website and they state that a reminder should have been sent with a form but I never received one. The photo expired about 3 months ago now and will need to go to the post office and get the appropriate form. They also want 20 quid to renew it but thats a moan for another post. Question here is am I still legal to drive.

Thanks guys, looks like I only have to worry about avoiding a 1000 pound fine then.
