could my transmission fluid need changed ?

hi folks, posted a few times on here before and you have all been very helpful so thought id ask about this problem aswell and see if you can help me out at all.

my car is a bme e46 330ci 01 plate. Got 116k miles on it. Anyway when im in the car and its cold it goes through gears 1-4 with no problems but if i put it into 5th, it doesn't want to come back out. The actual stick in the cabin will move but it feels like the shaft (unsure of the proper name) is still sitting in 5th and i have to really try and wiggle it out. Anyway, the reason im wondering if its oil/fluid related is that once the car is up to temperature , say after 10 minutes it goes in and out of 5th no problems at all.

I have seen some stuff online about bmw's having lifetime transmission fluid but then I have seen others saying thats not the case. Would appreciate any advice.
