hi

i was just wondering how long it should take do an engine swap on a 2004 grand espace 2.2 dci. my espace has been in the garage for 5 weeks this friday. the garage told me before it went in 9 to 14 days i rang them on the 14th day and they said it will be the week after. i rang on the third week and they said the same agen. i rang last week and they said they were waiting on a part from france and it would be another 2 weeks. during this time they have renamed the garage and seem to have moved units. i am in nottinghamshre but the car is being fixed in essex they have a web site and advertise for work on ebay.

is ther anything i can do or is it just a case of wait it out?

thanks john

went to london yesturday to get the car arrived at 5 got led through the garage and took to his office on the way i noticed my car with bumper off and engine exsposed. when i got to the office i asked the bloke if my car would be ready today and he said yes i heard them starting the engine up and looked out the office window smoke was everywher and it sounded like it did befor it went in loud banging etc. i was waiting in the office for 2 hours then he told me to come down to see the car. he then told me they was having problems with the fuel mix? and it was also missing cylinder because a sparkplug wasnt working because of a bad current from the cpu. i thought diesals didnt have spark plugs? while they was starting the car it didnt have exhaust, manufold, turbo, air filter, radiator and what looks like a mass air flow controler all was on the floor at the side of the car. i thought it would damage the engine starting it and attempting to run it withoutair filter and intake etc. when i put these questions to them they changed the subject to we have changed that too he pointed and i said the fuel filter and said its hard because ther is 3 different types.he also said he had a renault dealer coming out today to work out the missfire. before i went ther was an grand espace identical to mine he pointed to it and said this engine out of that as i was leaving the bonnet was up on the espace he pointed at and its engine was still intact and not missing. in my opinion he had not swaped the engine yet and that was mine still in the car but he tried to fool me. he said he would get back to me and should be fixed by sunday......

no i havent given them any money but they will want some if i remove the car the blokes in there look pretty hefty too. he did say if i was going to dispute the matter that it would end bad for me and that it was better for "us" more him to just let him get on with things. i felt like he was saying if i disputed it in anyway he would put the charge up or somthing along them lines. i let the car go ther because it looked pretty good the had loads of adds on ebay and a decent looking web site plus was about 500 quid cheaper than my local mansfield engine centre my mistake

reply from consumer diret

Dear Mr Leivers

Thank you for your enquiry to Consumer Direct dated 23/06/2011

Your reference number for this case is ********** and should be quoted in all further correspondence regarding this case.

Based on the information you have provided the key legal points in response to your enquiry are as follows:

When you have services carried out, you have rights against the trader under the Supply of Goods & Services Act 1982. This provides that work should be carried out with reasonable care & skill, for a reasonable charge (unless the price is fixed by contract), and within a reasonable time (unless the time scale is fixed by contract). It also provides that any goods & materials supplied as part of the service should be of a satisfactory quality i.e. free from defects.

If the trader has failed to fulfill the above requirements then he should come back and rectify the problem, without additional cost.

If the trader has breached the above act and you have given him/her the opportunity to rectify the faults without any success you could argue you have lost faith in his/her ability to carry out the work.

If this is the case then you may instruct another trader to rectify the faults and claim any costs back as consequential loss. You must inform the original trader before allowing another trader to rectify the faults. You should then proceed to request 2-3 quotes from other traders and forward these to the original making him/her aware of your actions.

I would advise speaking to the company in the first instance to see what they are willing to do and if the issue is not resolved make a more formal complaint via a recorded delivery letter (keeping a copy for your records).

There is a template letter available on the website if required

If the response from them is not satisfactory, please feel free to get back in touch with an update and further advice can be offered.

If the trader was threatening you or you felt intimidated by the trader this would be an issue to report to your local Police.

I will also make the details of your concerns available to Trading Standards for consideration. Your contact details will be made available to them and they can contact you directly if they require any further information or are able to provide feedback in relation to this enquiry.
