Another driver causing you to crash

Had a couple of close calls this morning with idiots pulling out of side roads without looking. First one I decided in the split second to drive around the offending van (slight blind bend also). I think if I decided on the emergency stop option I would have hit him. The other I couldn't do anything as it looked like I was going to get T boned.

In the first instance, does the idiot pulling out get off scot-free?
