if one receives an NIP for doing 36 in a 30 and it makes mention of an offer of a speed awareness course will this offer be rescinded when NIP is returned and police realise person driving has 9 points, ie is it possible to be offered a speed awareness course when on 9 points? and does it vary from police force to police force?

But I think only if you haven’t already done in the last 2 years.

I'm not certain that all forces share the same policy but for Lancashire the threshold speed for eligibility for the speed awareness course is up to and including 42mph in a 30mph limit. In addition, eligibility is conditional upon:

You have admitted to being the driver within 4 months of the offence.

Your admission has been returned correctly completed and your driving licence number has been provided.

You have not previously attended a course within the last 3 years.

I have their very paperwork in front of me now - fortunately not mine!!

Admit within 4 months?

I thought S172 required 28 days.

OK if keeper names driver, driver gets a further 28 days, making 2 months at most.

10% plus 9mph - fairly standard these days.

That's to give them sufficient time to proceed the matter to court, should the need arise.

That is what NIP I saw says also.

When they send out NIP they do not know who was driving and therefore do not know how many points driver has.
Your view is that when NIP is sent back and they check and see that person driving vehicle has 9 points they will not withdraw offer of Speed Awareness Course? ie you’d agree that points already on license is not relevant?

Perhaps I am wrong on this but I THOUGHT that once it was determined a driver had 9 points already then it was automatically a magistrates court issue ???????????????

I currently have 9 points on my license can I accept the conditional offer?

No. The matter can only be dealt with by way of a court hearing. You should complete the drivers' statement on page 3 and then "X" box 1. A summons will then be issued to you detailing the time and date of the hearing.

Conditional offer is of fixed penalty - 60 quid and 3 points. That is never available if you are on 9 points as you would be a totter.

Speed awareness course = no points so that's fine.
