Recently bought a brand new fiesta studio. In the brochure and ford website it clearly lists the car having electric windows but upon inspection it actually has manual windows. Where do I stand with this? Do I refuse to accept the car and demand some kind of compensation?

I'd imagine you'd be entitled to something, although if I was in your shoes I'd prefer to have the option fitted rather than accept money off as compensation. I wouldn't accept a car with manual windows though.

This really depends on how hard you are prepared to play. The problem with these things is the small print in the brochure which usually states something along the lines of the manufacturer reserves the right to change the specification at any time. However, if the brochure was extant at the time of order I would argue that the description of the goods in the brochure forms part of the contract and does not match the reality and, contractually, you have the right to reject the car.

Is there currently another specification that you would like, i.e. you would be prepared to re-order and wait? Is so then reject the car and re-order.

If not you could try and get them to fit electric windows but this could prove very time consuming and expensive for them. If you are prepared to stand your ground you can insist that they meet the contract they have signed up for. It may not be possible to do this and/or so expensive that the dealer will just accept rejection and 'chalk it up to experience' - not a lot you can do then unless you can prove you have suffered/will suffer damage in any way (very difficult) and are prepared to chase them through the courts.

If not any of the above then you either reject the car and walk away and find a car somewhere else or start negotiating on a reduced price or whatever else takes your fancy in lieu.

I've had a thought on this OP. Have electric front windows always been standard on this model? By that I mean that perhaps they're standard on 2013 model year cars and not on 2012 model year cars that perhaps you ordered?

Updated spec. I've just looked on the Ford website and they've removed the electric windows on the new Studio, the Style is now the lowest spec with that feature as standard.

I've done some research on this and the fiesta has had electric windows as standard since 2010 onwards. But I believe the fiesta had a specification update on July 2012 so clearly they've had time to adjust the brochure and website.

I've not yet spoke to the dealer. My car gets delivered on the 15th. Only found out yesterday when I had a quick look round the back at some of the pre-reg stock. Wanted to get some advice on here first.

I never asked about the windows situation when I placed the order. Presumed the website and brochure would be accurate enough. Funny how little things can just put you off.

Steve, I know. But it also repeats spec "CD player with remote audio controls and AUX sockets" on both models. And when you click on the link "fiesta studio" at the top of that page it clearly states the car as electric windows as standard.
