hi Guys,

I sold a car to someone on ebay just over a week ago, I put in the ad that there was an issue with the car and was very specific in what needed to be done to fix the issue and to my detriment told all bidders to bid accordingly to the repair cost.
I also put in other bits and bobs to be totally honest with the buyer about the car. he got the car for £1000 under trade btw.

The person loved the car paid me my money and left, he text me when he got home and said it was a lovely drive and he really enjoyed the process of buying from me and I was the most genuine seller he has ever met.
I then get a call from him saying that there was a crack on the top part of the windscreen and he wanted me to pay for ( he saw the crack when he was test driving) I offered to get it fixed through autoglass as a gesture of goodwill but he would have to pay the £50 excess, he then kicked of and said that unless I pay for it he will take me to small claims court.

today he asked me to cancel autoglass as the car is misfiring and that he wanted his money back.

do I answer respectfully as I have from the beginning or shall I tell him to ps off!

This exact con has come up on PH forums before. It's a con. Keep all the evidence you have re pointing out the cars faults. Then tell him to ps off !!!

If it's a private sale, then just ignore him. I hope you were paid in cash, rather than Paypal.

All as per the above. In basic terms, he has no legal right of recourse against you unless you are a trader. Tell him to fk off, and stop worrying, he has no claim to make in the small claims court (and any lawyer that he asks will tell him so).

In summary - tell him to do one, then stop all communication with him.

We need a sticky for these don't we. Advice always the same - caveat emptor, private sale, off you pop fella. Some buyers are hilarious.

you were going to get the screen done on your insurance a week after you sold the car to him? a little bit dodgy that.

yes my fault I offered to keep paying it until it was fixed. he could only do this week.

he did indeed pay in cash

Hilarious. He wouldn't have a leg to stand on in small claims court.. I don't know where these jokers come from but politely tell him to do one!

Offering to fix the screen was a silly thing to do. Get copies of the advert etc just in case he is stupid enough to go to court (some idiots are), then politely but firmly tell him you will not enter into any more correspondence, and if he comes knocking on your door, try not to get engaged in an arguement and be ready to call the Old Bill.

Unless, of course, you are a trader. In which case you should know your legal obligations.

Who are these people? Im a bit gutted I never run into these idiots,always hear these stories but it never seems to happen to me.It just wouldnt enter my head to come back a week later.

Absolsutely correct. Providng the op is not a trader.

hi I am not a trader, and I only offered to get the windscreen fixed verbally I never emailed him or text him
