However whilst being illegal to sell them, it is my belief that it is not specifically illegal to be running tyres which are not e-marked.

Can anyone confirm or deny this with a suitable reference to the law please?

I can't provide a reference, but it is not illegal to drive a car in the EU on non e-marked tyres or every EU border would have to inspect the tyres of every car entering. I have driven a car in the UK that was imported from outside the EU and passed an MOT with non e-marked tyres.

Thanks Chaps. The OPSI link talks about supply, I was hoping to find something related to use.

That's the point - anything is legal unless the law says it isn't.

The law does not say anything about tyre use - just supply. And since it doesn't say anything - there is no reference to give.

Good point. But there are rules on tyres (some or all of) which are tested in the MoT.

Does anyone know where they are? Con & Use?

The tyres fitted to Evos (certainly VIIs and VIIIs) in Japan are not e marked, but the cars are legal to be sold over here.
However when you want to replace the tyres, due to the lack of e marks, you cannot replace like for like, as Yokohama are not allowed to sell those tyres here.
