hi, i got a new car a few weeks ago (from Durham and I'm in Leeds)

Last week i got pulled over because the police did a check on my car and it came back as from Durham and wanted to know why it was in leeds. i said i had just bought it.

it came back as taxed, insured and MOT'd. he check tyres etc and everything was fine.

He said "I'll just check your licence and let you be on your way" i said ok

When he did this on the radio....it said i had a full licence but it had been expired...he asked me why and i didn't have a clue.

He said he could report me for driving with no licence and take my car but as i was just round the corner, he let me drive it home but has put a marker on my car as owner not got a licence. He told me to ring DVLA and ask why my licence has expired because its only 8 years old.

i rang the DVLA the next day. after 40 minutes of listening to the engaged tone and then being on hold, i got through.

i said i had been pulled and it came back as my licence has expired, can you tell me why please?

they took my details and came back with, "you got some points a few month ago and we didn't receive your licence to put them on" i said did you ask me to or anything? they said they would probably had sent me a letter asking me to. i said oh ok i didn't receive it.

he said ok, just send us your photo licence and counterpart and we will put them on for you and you cant drive till you get them back.

i said ok and he said ok thanks and hung up.........my confusion is......where do i send them to AND do i have to pay a fee? I've been looking online now nearly a week just for these 2 answers because i can't drive till i get it back and i've still got it

Well, that was difficult to read!

So, you're unsure if you were speeding but you're going to take their word for it and accept the points anyway?!

This happened to my OH last year - she had her licenced endorsed at the police station, but since she failed to send it to DVLA they "expired" her licence. Didn't help that she hadn't updated her licence with the new address.

I found out by accident when I tried to make her a named driver for my company car.

She filled out a licence application form, sent off her licence (with the correct details and photos) with a cheque and received, about a week later, the cheque (not sure why) and her updated licence.

No fine, no trouble - I guess she was lucky with that one.

If you don't accept the allegation (that you have been convicted of in your absence) then you need to make a statutry declaration at the court that convicted you. This will write off the conviction and the points and then you can defend yourself if you so choose. The dvla will be told that the conviction has been set aside and will remove reference to the points and you can have your licence back.

Are you sure you haven't been convicted of failing to name the driver which carries 6 points? If you knew nothing about the matter then I would expect you not to have responded to the NIP/s.172.

Did you know you had been reported for the offence of, what ever it was you got some points for?
You didn't object on the phone to getting points so you were expecting them? What was the offence?
If you don't send your licence in to have points put on DVLA revoke your licence.

So why haven't you rung them back & asked?
Don't be so silly!!! OP has done the right thing by sitting down and having a good think about it. You don't want to rush these things or you might send it to the wrong place!

Phone the same number and get it sorted in a few minutes...are you mad? silly

Either the information you have given is incorrect or the DVLA call centre staff have given you the wrong information.

You can legally drive for 12 months after your license is cancelled –

DVLA said:
You may still continue to drive for 12 months provided that you meet the following criteria:
• you are not prevented from holding or obtaining a license by a Court or on age or there are no medical reasons;
• Any conditions which apply to the license are met.
...
However, after this 12-month period has ended you will no longer be entitled to drive until you make an application to us to renew your driving license.

I would imagine if you wrote DVLA on an envelope it would get there. Add Swansea if you want to. And even SA99 1BA to be really pedantic.

But take it to a post office and send it recorded delivery and they'll fill in the address for you.

Do keep a copy of your licence and the counterpart in case it gets lost.
