Just a quick one here .. does anyone know ( or has opinions on ) the legality of the rights to money paid into your bank account that isnt yours ?

Obviously there is a moral issue... but it would seem that a bank credit has infact been credited twice to the same account. The money has stayed in the account untouched for the last 36 hours ... Can the bank simply take the money back, correct the error .. or can I withdraw the cash and keep it ??

Should I own up ? <yer right!>

The bank will realise soon enough. Oh and taking it when you know you aren't entitled is theft. Sorry.

Interesting ... Theft from my own bank account .... Hmmm gotta stop the wife from checking the account and shopping then.. if she see's £1000 extra in there .. its not gonna last 5 moinutes !

Close the account immidiately, then open one elsewhere.

for the 10mins it takes, free money is great

It's not from 'your' account, though. You know it does not belong to you, you have chosen not to tell the person you know it belongs to (the bank) and if you withdraw it, it's a pretty safe bet your intention is not to give it back. It pretty much covers all the Theft basis.

As an ex banking lawyer - they can take it back. It's not your money.

If you move it's theft.

I've had a double-entered payment before now. Lasts a couple of days before the bank correct it.

I remember when my mum had a significant payment (several k+) into her account, when she pointed out to the bank it wasn't hers they insisted it was. So she sat on it for a while -just to be sure, we weren't rich- then spent it. Then again, I don't take seriously most of what she said or has said in the past...

This happened to me the other day, they put in my pay cheque twice.

Interesting thing though, although they took the money back out the next day by instant transfer, they left the original doubled payment to clear as if it were a real cheque. This meant that for several days I had £xxxx less showing as cleared spendable funds then I should have had.

Luckily no drama, but what if I were planning a large purchase, eg a car on those days, could've ruined someones day!

Oh yeah once when I was about 12 I had £200 put in out of nowhere, they never took it back and it was happily spent smile

The bank will have had the interest on that 'uncleared' cheque. Ask for it to be put in your account.

The account is due to be emptied for a Big Purchase ... cash flow is the issue ... waiting for credits that are still in the system ... imagine my shock when I saw the credit in the bank (before I had received the "Paid" email from work !

As rubbish as it is, instances such as these are governed by the 1996 Theft Act (as amended) Section 2, pertaining to dishonestly retaining a wrongful credit... the Monopoly board lied! The bank will dip back in and recall the money...

A couple got $10mil deposited incorrectly to their bank account here 6 months ago. Managed to get 6mil or so shifted before the bank caught on.

Bank has recovered about 5-6mil so far and the couple fled to HK/Asia and havnt been seen since. biggrin

Surely its never theft. A lot of account holders wouldn't notice an extra £1k in their account so there is no problem withdrawing it.

Of course when they realise and ask for it back you'll have to repay it (on your terms within reason).
