It might be an idea when you phone the BiB to enquire about the whereabouts of YOUR FRIEND'S BONG to emphasise that YOUR FRIEND left it at your flat and he's concerned about getting HIS BONG back.

Word of advice, when you do stroll into your local plod shop demanding satisfaction, it's probably best not to ask for your "bong" back. Hookah or sheesha (sp?) should make you come across as less of a pot-smoking stoner.

OP - just so they know they can't mug you off with an excuse, it is best at times like these to film what happens from the start of the trip to the police station on your mobile.

Then you can post it up somewhere on the net, and if you don't get any joy, we can help you further.

My Gandad used to have a Gong. As children it was great to bash it to call dinnertime. I think I'd be annoyed too if the Police stole this fine musical instrument. Oddly, his daughter (my Mum) used to use a ruddy great bell to call dinnertime. Neither had a house particulalry big....

A bong is generally only used to smoke illegal substances in this country. As shown by the OP admitting he uses it to smoke illegal substances.

Money has the sole intention of being used as well money however people subvert it's use.

Cars can be used for criminal activity but are not primarily used for that purpose.

People are making quite hysterical claims. The reality is whether people agree or not certain drug use is prohibited in law. As such under the MDA and Pace certain powers exist to seize drugs or the paraphernalia linked to their use.

Once an officer is lawfully on a premisis they can seize things they see but wouldn't be allowed to search as such.

There will have been an entry form left. Which if the item was taken by police would bs listed on. If it's not listed it's probably not been taken.

Was the property left secure? Or insecure?

If the op goes to the station if they have taken it and there are trace elements ( it'll be more than a few molecules) then the have lawfully seized it and can have it destroyed. Even if the Op 'takes a caution' he won't be entitled to his paraphernalia back.

The op is best to call the station before attending and quote any reference and ask if anything was removed from his flat. Without mentioning what. Under law they are obligated to answer. He can then decide how he wishes to proceed.

However just to clarify. How was the property secured?

Has the OP gone and asked the police and stopped having a kiddy hissy fit yet?

If I was the OP I would be asking the people on here nicely the simple questions.

1) flat got broke into as leak was in flat going to next doors flat causing damage, whilst in there the police may or may not have taken my expensive bong which I have used a few times.

2) What is the chances of me actually getting it back when ringing up and asking for it back like? Will I get told to eff off as I have used it in the way it was intended and I know its not legal? Will they then want to talk to me further?

3) Im not trying to justify my actions by saying its as innocent as downloading a film off the net, so why am I being victimised here, etc... I just would like to know if I can get it back?

Does that not sound a little better than what you wrote?? Yes I would be a little upset to but then throwing a hissy fit about something you know is illegal to use (but its ok as its only now and again) is not going to get you anywhere is it?

It's speculative because the officer who took it got lucky. There's no way he could tell from looking at and examining my bong that there were any trace amounts of any illegal substance on it. I'm sure their forensic department will be able to find 3 or 4 molecules though.

There was no mention on the note left of the bong at all and that's what pisses me off. I was last to leave in the morning, locked up, and was first home this evening. So unless my house has been burgled and my bong stolen, I'm going with the "police took it" theory.

For those interested, it was a Roor BubbleMaster, and a present from my girlfriend before I left for uni. Just typing this out makes me mad. I don't care what anybody says, the cop who took it is an asshole. I'm going to phone tomorrow and ask for 10 minutes with someone to put my point across.
So, you want to be a police officer do you?

OK, let's look at the facts of the case:

1) Do you have any evidence the police took your bong? No.

2) Do you have any evidence that only the police accessed your flat and immediately secured it? No.

3) Do you have any evidence that shows it is impossible for anyone but the police to have taken it? No.

So you think the police took it but have no evidence. If you can't work out what a weak position you are in evidentially, may I suggest you pick another career?

Since when has recording soap operas been illegal?
I seem to recall copyright law saying you can only keep your copy for six months? It's a faint memory from my school days though so I could well be wrong.
